My car has been damaged by the garage, neither Servicing stop nor the garage are responding to my calls and emails asking when they will repair - who is responsible SS or the garage?
    Garage.
SS are just a 3rd party booking agent.
That's not what the Ts & Cs say:
You are contracting with Servicing Stop Ltd...
and the clause quoted earlier clearly indicates that post-transaction activity needs to be handled via SS.
SS aren’t responding to my emails
their customer support  stock response “yadda yadda ….. respond to you in 5-7 days” that’s been 10 days now - what can I do other than let M&S credit Card sort it out?
Yes, I was addressing your question about who's responsible between SS and the garage, but if they're not being responsive then your card company may be able to help, so if you've raised the issue with both then all you can really do is wait.  Is the car drivable?

Hi yes it’s driveable, the damage is mostly cosmetic. I was planning on selling it next month but looks like I’m stuck until someone accepts responsibility. I’m finding it hard to believe that they can get away with ignoring the issue. What if M&S Bank dont take this on, am I headed to the small claims court? Are the garage obliged to share the photos they took before they collected for service?  Thanks

If tbey charged the amount they quoted then they did not overcharge.

They claim to be cheaper than a main dealer, not every other garage.

You could find another garage that charges less than you local gargae.

A tin of beans is dearer in the corner shop than in a supermarket but you canlt ask the coprner shop to pay you back the difference.

ok so SS have responded after almost 2 weeks. The garage are saying they’re unaware of any damage (blatant lies as they took photos before and after) and want to take the car back to assess
i did not trust them to look after my car but this has just made it worse
what are my rights in getting it fixed locally with a garage that I trust ?

You have the right to get it fixed locally with a trusted garage if you wish, but don't expect anyone else to pick up the tab if you choose that route.

So what are you saying, that I have to let the garage that has lied and damaged my car have my car back?
looks like you’re saying that the garage can just do what they like and I have no rights at all !!

No, that's not what they're saying.  They're explaining your consumer rights and the right of the garage to be able to put right anything they've done wrong.

As stated, you don't have to do anything, but if you choose to get it sorted somewhere else, it's going to be relatively easy for the garage to dispute your passing the cost onto them.

No, you're putting words into my mouth - you're clearly upset about all this but will need to put all the emotion to one side when ascertaining what your rights and options are....
