CCJ and defendant now deceased.

I am helping to settle the affairs of someone who has recently passed away. Amongst other issues, a CCJ was issued in recent months.
This related to a parking issue, as far as I know, it certainly involves a private company involved in policing parking on private land.

I am looking for advice on how to process this matter.

  • The experts on parking tickets reside on another board, and it is probable best to get the personal representative of the deceased to post there. The first step will be to apply to the courts to have the judgement set aside and the process should be no different for the estate representative to deal with.

    If however the estate is insolvent (not enough money to cover funeral expenses and debts) there is another easier option and that is to write too the creditors informing them that the person has died (include copy of death certificate), that there estate is insolvent and that no one is administering it.
