Help needed with a Car Park Securities Ltd letter

Hi there
I'm hoping someone can help me.  I regularly drive my husband's car and on 28th August, I parked up in a car park, paid for 3 hours, but overstayed by 17 minutes as my meeting went on longer than it should have.

The car is in my husband's name, so on the 12th September, we received a Parking Charge addressed to him, being the registered keeper.  This is 15 days after I parked there, but they have printed a 'date of posting' on the letter as 4th September! It still didn't arrive until the 12th, but I have no proof as nothing was sent recorded.

We've been super busy with opening a new business, and I have procrastinated unfortunately.  We have now received a 'Pre-Action Protocol letter', and the first line says 'This letter of claim...'etc.

We haven't been issued any court proceedings yet, but I believe it could be close.  Have I completely messed up?  I haven't replied to say it was me driving - I haven't acknowledged them at all yet.

    No biggie!

Which of you wants to defend it if they did try a small claim (which they might not)?

Decide now who is going to be best placed to follow our advice if you get a court claim...and if it's you then he needs to transfer liability to you by him naming you as the driver. And giving your postal address too.  Now (and not by phone, obviously, and HE must name you, not you naming yourself!).

Or if he'd be better at this stuff, then he replies as keeper to the LBC. Is it a real one or just a debt demand pretending to be a LBC? The NEWBIES thread second post explains.
