Excel parking fine (I think)

I went for food yesterday and parked in a car park next to the restraunt. It was a pay and display but only took money or had to use an app and type in the site number to pay. But when you typed the site number in it kept saying it wasn't recognised so we left it. There was a number to ring but we were already late and saw a few cars without tickets so thought it would be fine.

Came out 2 hours later and I had. Privacy notice on my car not an actual fine. 

At the back of this it's ticked excel parking services Ltd and has an x in the box saying I can come tact the data protection officer. I think this means they're going to get the details from the dvla then send a fine in the post?

Do I have to pay this fine when it comes?

BTW I am in Wales.

    Its definitely not a fine, private parking companies don't issue fines 

    Its a warning that the keeper details may be obtained from the DVLA database and a NTK PCN letter sent by Excel ( or possibly by VCS. ) to the registered keeper in the next few weeks 

    The NTK PCN letter Will be an invoice. ( Not a fine. )

    Its your choice whether or not you pay it after it arrives in the post, its not compulsory, its one of several options 

    I suggest that you study the newbies sticky thread in announcements and think carefully about the matter , especially plan A

    Private parking charges aren't fines.

    Of course you don't pay Excel.   But yes they will now get your DVLA car reg data so I hope this isn't a lease car and I hope your address on your V5C is up to date?

    Go on foot this week/end and get some pics of the sign showing the location code and then a short video taken from one phone of another phone showing what happens when you try to pay & select that code.

    Everything up to date and no not a lease car. I'm in South Wales not Sheffield. The place is 40 mins away from me.

    I'll do what you said with the phone this weekend and keep the video. Cheers mate.

    You need that evidence because the signs will change.  You need to evidence this weekend that the advertised code on signs does not work in the app.

    Pics of signs are also very useful generally if they later try a small claim. So walk around and get pics of all t&cs signs and a wide view of the ENTRANCE approach, taken from across the road as well (even if there's no entrance sign: that's good for your case). 

    Paint a decent picture of their failings. Keep the evidence safe even when changing phones.  Tell Excel if you move house within 6 years because you must not ignore a claim form.

    Sorry about that and thank you. So if they fix the app by Saturday I should just pay it? It clearly states you have to pay but we had no change and no cards as we use apple pay so couldn't even pay over the phone. Hoping it's not £100 none of us can remember how much it was

    It's £100 reduced to £60 but DO NOT PAY IT. Nobody will tell you to pay Excel.

    I don't understand how posters ever make that leap.  The very idea makes us spit out our tea!  Of course not.

    But I don't understand how I get out of paying then. I literally didn't pay to park?

    You aren't "getting out of" anything. They made it impossible for you to pay.

    That's a winnable defence and as you know from when you read the second post of the NEWBIES FAQS thread before you posted, there's no risk.  Please read that post again if you can't recall it.
