Chimney stack

We have a chimney stack on the back of our terraced house, this is on the neighbours roof butting up yo my roof, it needs work doing and they want to go halves, the thing is there is no evidence of a chimney breast on our side as our fireplace is on the other side of the property, anyone know our rights, thank you

Sounds like its their chimney, what work are they planning on doing? I have a similar situation with my chimney which just had work done to it, at my cost, at one stage the chimney was being lowered but doe to the fact it would have required work to their external wall that the chimney was attached to I chose to have it repaired instead as it wasn't in as poor condition as expected. Hi it will either be repaired or dropped depending on prices, are we obliged to contribute do you know, and would a party wall agreement be needed if we decide to contribute, thanks0

Hi Gaupa, check your deeds and see where the red boundary line runs. Also check the wording in case it makes any reference.
I'd also have a word with every other house to see what their understanding is.
In essence, tho', see if you can determine whether the stack at all crosses the centre of your party wall, or is fully on the neighbour's side.
Any chance of a photo of the roof line, also showing where you believe the true boundary line runs? Any obvious boundary features - fences, gutters, paint lines, stuff like that?
I suspect it was intended that each house had its own stack to look after, and that one ain't yours.
How thick is the party wall between you - single or double skin? If you can determine that the stack does not cross the centre of the party wall, that should be pretty conclusive. If hard to determine, try going to the upstairs room next to the boundary, measure from the inner party wall face to the nearest window reveal, and transfer that measurement to the outside - that's the start of the thickness of the party wall. Assuming the wall is either ~5" thick (single), or ~9"-ish for double, does that help to determine whether the stack is fully on their side?0
