Hi MSE Team,
I am hoping you may be able to offer some advice about a recent claim against myself from Premier Park Limited.
Firstly, I must admit, I am very confused with the situation I find myself in.
The
first I heard of this supposed unpaid parking was when I received the
claim form from the Civil National Business Centre on 05/10/2024, which I
immediately responded to via the moneyclaim.gov.uk website, explaining that
I paid for the parking in question and can see the transaction on my
bank statement and shared the transaction details with moneyclaim.
I
then got married on 12/10/2024 so tried my best not to worry about it
or let myself get too stressed as I wanted to enjoy my wedding day.
Unfortunately, it has been playing on my mind ever since receiving the
initial notice.
I
have since received a Notice of Proposal Allocation to the Small Claims
Track, requesting that I fill out the Directions Questionnaire and file
it with the court and Premier Park Limited by 8th November.
Quite
honestly, I have no idea how it has got to this because, as I say, the
parking was paid at the time and I have the transaction on my account to
prove it.
I
have tried calling the court today to understand the situation, what
the next steps are and, if I need to complete the Directions
Questionnaire, how best to do it. But, having been on hold for roughly
30 minutes, I was unable to get through. This is why I thought I would
reach out to the MSE Team to ask whether you had any suggestions or advice on how best to proceed and get some assitance with the process, as this is the first time I have ever had to deal with something like this.

Firstly. Too late to complain about the circumstances of the case, you received a claim form, unfortunately you have filled in your defence on MCOL without consulting us first,
please post the exact details of that defence below, in full, verbatim, not a summary , just what you wrote
Now this is at the N180 DQ stage, you have to fill it in and email it to the CNBC in Northampton using the DQ email address and cc in the lawyers involved. ( Who is it. ? )
The CNBC cannot and will not assist you in any of this, apart from telling you to follow the process ( and probably telling you to get legal advice, nothing else. ) please stop phoning people, its not necessary
Study the second post in the newbies sticky thread in announcements by coupon mad at the top of the forum, third one down , plus study the 12 steps in the defence template thread in announcements, checking the first few posts in that thread too
You can download the N180 pdf from the gov website
Those 2 threads will tell you how to fill in the Dq form and where to email it
Dont miss the deadline for filing it
You can study how it got to a court claim after you have completed the current paperwork
You must comply with the court orders
There will be no quick resolution, this will probably take 6 to 12 months in total
Post a redacted picture of the PoC on the bottom left of the claim form, hiding the VRM details ONLY
Do not post an unredacted picture of anything, no personal or private details

Replying to Gr1pr:Details of defence (verbatim): "I dispute the claim as I paid for the parking that Premier Park Limited are claiming I did not pay. I have checked my bank account and can see the transaction: 'Card Transaction 7964 09DEC23 D PREMIER PARK EXETER GB'. I am happy to share my bank statement if needed."Have filled out the N180 DQ form and emailed to DQ.cnbc@justice.gov.uk as well as the lawyers acting on behalf of Premier Park Limited, who are Gladstones Solicitors Limited. Disappointing to read that you have already filed a Defence because those Particulars you have shown us are woefully inadequate.
It is alleged that the driver 'parked in breach of the terms of parking stipulated on the signage (the contract)' but nowhere in those Particulars is there any explanation of what the driver is alleged to have done wrong.3 -

KeithP - thanks for your comment. Please can I ask what the best course of action would be? For someone that has never had to deal with this kind of claim before, it would seem that filing a defence is the only option.Is that not the case?0

Read the template defence in announcements near the top of the forum, compare your defence to the template defence, chalk and cheese. You have not included nearly 30 paragraphs that should be in the defence you submitted
In short, the Claimant's POC is inadequate, and your defence is inadequate1 -
Hi Gr1pr - thanks for guiding me to the template defence. Had not seen that before. Clearly, my defence is nowhere nearly as detailed. I just hope that the fact I paid the parking and have proof of the payment will weigh the decision in my favour. I'm not sure how it couldn't, but then again, there is clearly a lot I do not know about this process and best practices throughout.Very frustrating that anyone has to go through all this for what I can only assume is an error with the system Premier Parking Limited use to match up payments with the parking itself?!0

I suggest you check the address on your vehicles V5C logbook. If you have moved it is probably out of date and that is why any previous letters have never arrived. If so you should update it to prevent this happening in future.
As for their inadequate particulars and your limited defence I would still quote Chan in your Witness Statement for the judge to consider. Did you have to enter your Registration Number at this car park. If so maybe the issue was a typo which led to the failure to meet T&Cs rather than ‘not paid’. Could be an overstay or perhaps you parked outside of a marked bay. Who knows until you see their witness statement.1
