Fraudulent Car Dealer

So I have this dilemma, on the 16th of October I bought a used car from a dealer. One of the major selling points was that it still had 18months of warranty from another very reputable dealer, Parks of Stirling. However, upon reading the small print, the warranty states that if the car is sold to a dealer the warranty is void, also the sale has to be transferred within 7 days of a private sale. So basically, the garage I bought it from is getting the previous owner to go to Parks today and lie about completing a private sale and the date it was sold. The Fraud Act 2006 does not apply in Scotland, but I am totally uncomfortable with this whole transaction.

    How old & car details always help in these matters

    Go back to dealer & explain to them.
    police will not be interested as civil matter.

    In the end what are you looking for here, are you not happy with the car?

  • The previous owner, bought the car 2023 and paid the garage for 3 year warranty. It's a 2015 Discovery Sport. So the warranty should last until 2026 but in order to do so, the previous owner and the garage will have to lie, if they are successful I'm concerned that I would be colluding in fraud.

    You would be knowingly benefiting from fraud.  Suggest you do as Aylesbury_Duck recommends.

    If you live in the area I would visit Parks and ask them if the warranty transfer is valid in the situation you describe.  Even if you don't live in the area I would phone them and ask.

    You say you bought from "a dealer".

    Do you know that this "dealer" has actually bought the car from the person Parks sold it to?

    Or is it perhaps possible that your "dealer" is selling it on behalf of the owner who bought it from Parks?

    Not sure what point you're making here? Obviously fraud is still a criminal offence (at common law) in Scotland.

    Is the dealer aware that the warranty will not be transferred?

    It is possible that they have assumed it would be.

    Have you challenged them about it?
