Ending Personal lease hire contract
Help - I have a car on lease which is due to come to an end at the beginning of December - I am able to early terminate the contract. Have a new car on order which is ready to be delivered Here is my problem - my current car now has a fault with the onboard charger so has to be replaced under warranty - part is on back order so may take weeks - lease company are saying I can’t return car until it’s fixed and are saying I have to keep paying for the car until then! My argument is it’s not my fault the repair under warranty can’t be done more quickly - I feel it is unjustified saying I have to keep paying until it’s repaired and returned - it is still drivable! Any thoughts?

It only refers to having damage repaired before return as far as I can see. At the end of the day why should I be penalised for a manufacturing fault!!0

Is it immediately apparent via a warning light or lack of functionality?0

It will state you are responsible for returning the vehicle in the condition set out in the contract, otherwise you pay the penalty set out in the contract.
If it was no longer under warranty you would be expected to repair it before returning it, which you'd have to pay for.
If you couldn't do that in time, you pay the penalty set out in the contract.
As it is still under warranty the cost of repair is down to the manufacturer, but the contract still states you are responsible for returning it in the condition set out in the contract.
There will be nothing in the contract that differentiates between the the two.
The only difference is about who pays for the repair, your responsibility to the lease company's contract stays the same.
Plenty of others got caught out with the same thing after the pandemic when parts supply dried up.
Long waits for repair saw them sitting on leases and unusable cars far longer than expected while the dealers waited for parts, then waited to fit them all in.
As for it being "unfair", I would agree, but the time to consider that was before you signed the contract.
It's one of the drawbacks to leasing, you don't own it but have the responsibility of it's up keep and returning it in the right condition.
In your case the cost of being able to do that is covered under the warranty, it's just the manufacturer can't supply the part.
To be honest, your beef is with the manufacturer not being about to repair it in good time.
But the warranty is another "contract" with it's own clauses that will cover off scenarios like this.
