My niece parked at Shoreham Port Authority and paid through the PayByPhone app but mistakenly entered the wrong registration. GXS Services issued a notice on day 14, but it only arrived two weeks later. They provided a certificate of posting that’s unclear to us. We appealed to GXS, explaining the keying error and noting that there was no revenue loss, but they refused to cancel the fine. We escalated to the IAS, yet GXS has not shown evidence that the incorrect registration was in the car park. We even offered to pay an admin fee for verification. I don’t expect the IAS appeal to succeed. Any advice on next steps?

    Please show the inevitable IAS rejection when it arrives because I'm collecting them for evidence for the MHCLG.

    Question: Why does anyone use that car park anyway?

    The real roads - public highway - adjacent to the Portslade / Southwick / Shoreham coast road on the North side are all free to park on.

    As you can tell - when you search the form for the words in bold (above) and read previous advice - I'm a local lady.  
    I'm very familiar with GXS, who can be safely ignored (as long as you don't do something silly like move house and not tell them).  Please don't show us the 'Trace' or Debt Recovery £170 threatograms.

    Sit tight but I'd like to see the appalling template drivel churned out by the non-impartial so-called IAS assessor please.

    You shouldn't have tried that farce.  No harm done but it's long seen as a kangaroo court by reasonable people.

    Shoreham Port’s complaints form is not an alternative for car parking appeals, which must be made via GXS’ appeals system and IAS. If you have received a parking charge notice or a letter notifying you of the charge, please follow the instructions included and submit your appeal with the proof of payment you have mentioned below, to GXS and IAS if you wish to appeal and if you are within the time frame permitting this.

     

    With specific reference to your correspondence below,

     

    • Everyone who wishes to park within our estate must observe the parking regulations displayed on our signage and it is the responsibility of the driver to abide by these.

     

    • The management of parking across Shoreham Port’s estate is conducted legally and through GXS, an established professional operator.

     

    • Parking enforcement enables us to regulate parking activity, thereby ensuring that spaces are available for all our stakeholders.

     

    • Our parking enforcement contractor is an independent company. GXS are crucial to the safety and management of our roadways.

     

     

    May you contact GXS directly about this matter as Shoreham Port is unable to assist.

    The Independent Appeals Service (IAS) has received a decision from the Independent Adjudicator regarding your recent appeal for the below PCN.

    Parking Charge Number (PCN): A75977
    Vehicle Registration: GJ18UOM
    Date Issued: 18/09/2024

    Appeal Outcome: Dismissed

    The Adjudicators comments are as follows:

    "The Appellant should understand that the Adjudicator is not in a position to give legal advice to either of the parties but they are entitled to seek their own independent legal advice. The Adjudicator's role is to consider whether or not the parking charge has a basis in law and was properly issued in the circumstances of each individual case. In all Appeals the Adjudicator is bound by the relevant law applicable at the time and is only able to consider legal challenges and not factual mistakes nor extenuating or mitigating circumstances. Throughout this appeal the Operator has had the opportunity consider all points raised and could have conceded the appeal at any stage. The Adjudicator who deals with this Appeal is legally qualified and each case is dealt with according to their understanding of the law as it applies and the legal principles involved. A decision by an Adjudicator is not legally binding on an Appellant who is entitled to seek their own legal advice if they so wish.

    I am satisfied that the Appellant was parked in an area where the Operator has authority to issue Parking Charge Notices and to take the necessary steps to enforce them.

    Images, including a site map have been provided to me by the Operator which shows the signage displayed on this site. After viewing those images I am satisfied that the signage is sufficient to have brought to the attention of the Appellant the terms and conditions that apply to parking on this site. 

    The terms and conditions of parking at this location are such that drivers must make a valid payment for their parking session. In the data provided I can see that no payment was made for the Appellant's VRN. It is the driver's responsibility to ensure that they make a valid payment and otherwise conform with the terms and conditions of the Operator's signage displayed at this site. This includes making payment for the correct vehicle parked on the site. Mitigating/extenuating circumstances cannot be taken into account. Whilst I appreciate the argument made by the Appellant, this is not simply a keying error; parking was paid for an entirely different vehicle. Therefore the payment was not valid. As such, on the basis of the evidence provided I am satisfied that the Appellant was parked in breach of the displayed terms and conditions and that the PCN was correctly issued on this occasion.

    I have considered all the issues raised by both parties in this Appeal and I am satisfied that the Operator has established that the Parking Charge Notice was properly issued in accordance with the law and therefore this Appeal is dismissed.
    "

    As your appeal has been dismissed, the Independent Adjudicator has found, upon the evidence provided, that the parking charge was lawfully incurred.

    As this appeal has not been resolved in your favour, the IAS is unable to intervene further in this matter.

    You should contact the operator within 14 days to make payment of the charge. 

    Should you continue to contest the charge then you should consider obtaining independent legal advice.

    Errr...if they read the 1st October CoP they'd find that's the very description of 'a keying error'.
