Cohabitation Agreements in Scotland - Sole property owner advice

Hi all,

Just looking for some cohabitation advice relating to property and law within Scotland.

Over the last couple of years I’ve been through divorce and have just bought my own mortgage property.  I’m lucky that I have a significant deposit on the house at £200k on a £350k house.

I’ve been dating and staying with girlfriend for some time, she doesn’t own any property and thus is in a rented home.  We both have good careers, with comfortable income. 

We’re confident in the relationship thus far and planning for her to give up the rental and stay with myself, we’ve talked about finances and how it may all work, just wondering;

1 Is it worth arranging a financial cohabitation agreement?

2 Thinking worst case scenario is my sole owned property safe in the event of a break up?

3 If she pays money towards my mortgage / bills, what typically happens in the event of a break-up, are there expectations on me to refund?

    If she contributes towards your mortgage she will acquire a beneficial interest in your property, to keep things simple her contribution should be limited to 50% of household expenses, utilities and council tax.
