  • Coupon-mad - just looked at the nearest three and all have terrible reviews. Citing one judge in particular and stating they do not want to look at the evidence provided :(

    AND UPON the Court taking notice that the Claimant has issued and an unjust, unenforceable and Illegal original Claim against the Defendant
    Change as above.  Presumably, when you submit your Draft Order, you will put the date of the judgment?

    Hello Le Kirk - thank you for that. I did not see my mistake. Yes, I have the date of the judgment on the Draft Order.

    Do not worry. You have no choice anyway because even if you'd applied to the CNBC it obviously ends up allocated to your local county court.  Same court!

    Ring them now.

    DO NOT MENTION EVEN KNOWING ABOUT A £303 FEE LET ALONE HAVING PAID IT.

    ASK THEM IF THEY CAN SEE IF A HIGH COURT WRIT HAS BEEN ISSUED?

    SAY YOU HAVE SEEN A POSSIBLE HCEO IN YOUR STREET THIS MORNING AND HAVE STAYED UP ALL NIGHT AND HAVE AN URGENT APPLICATION ALL SIGNED & READY WITH EVIDENCE.

    DESCRIBE IT AS 'AN APPLICATION TO STAY THE WRIT IN CLAIM NUMBER xxxxxx'

    ASK WHERE TO URGENTLY EMAIL IT OR DO THEY NEED A PRINTED APPLICATION IN PERSON AS YOU NEED TO GET THIS IN. 

    Hopefully they will only ask for £15.

    ONLY if they ask for £303 do you say that you've already paid that fee...etc.

    If you couldn't get through then email it to the CNBC now and refer to the fee already paid.  Then call the CNBC first thing at 8.30am and check they have got it and that the application will be processed urgently.  At least then it is in the system and you can then email DCB Legal and DCB Ltd (both) to call their dogs off.

    But putting a 'stay the writ' application in via your local court would have been twenty times cheaper and twenty times more immediate and prioritised, so I hope you did get through.

    I gave up after being 63 in the queue. I have officially been awake for 38hrs and I'm crashing. 
    I have emailed the application off and cc'd DCBL. That way they know I have submitted it as URGENT and have stated re: the possible HCEO this morning. I'm going to work from home tomorrow so we will see if he turns up again.

    DBL or whatever they want to call themselves, cannot plead ignorance to that application as the court will see they were emailed too.

    Did you pay £15 at your local court to stay the writ, or £303 to the CNBC for a CCJ set aside?
