Can you return mobile phone after 2 days if you have used it with a sim?

Hi!  I made a mistake and ordered a phone that is huge and heavy. - It said nothing about the size when I ordered it  and didnt check - I urgently needed a new phone as my last one died suddenly and was unusable with an unusable screen.  I now realise that my new phone is not workable for me and I need to return it to Amazon.  Will they accept it as I put my sim in and used it for 2 days?

They can't refuse the return, however they can deduct a % from the refund due to you using the phone.

Did you not realise it was huge and heavy before putting the SIM in?

You will need to restore it to factory settings ao it’s not linked to any of your accounts.

Pedant alert - it's could have, not could of.

Ensure you make it clear to the seller (who might or might not be Amazon themselves) that you are exercising your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel the contract.

Maybe it was the SIM which made it too heavy.

Which could be quite a significant percentage as they can no longer sell it as a new phone. Maybe worth looking at what one of the more reputable re-sellers (eg Back Market) would charge for the same model in mint condition to get an idea of what a fair reduction may be.

Only you can decide if the size and weight difference is worth that amount of loss to you.

Especially if all OP's contacts were stored on it.

Cancelling with Amazon also carries a risk of your account being cancelled if they deem you a problem customer.  Are you willing to potentially set that ball in motion?
  • I'm curious, did you get the screen repaired on your old phone?

OK - whilst I don't want to call you a liar, that is *very* obviously not true.  Screen size is the one thing that mobile phone postings in online shops make the biggest song and dance about.   It's literally the first thing mentioned in the vast majority of cases.  It is totally unfeasible that the size of the phone would not be mentioned *at all*.

You not realising what that translates to isn't the same thing as it not being mentioned.

My wife recently got a new phone.  Although it is only marginally larger than my phone I was surprised by how much heavier it is.
