Land Registry timeline - please help!

I’m hoping to get some help/advice on a land registry issue that’s been going on for a while. 

I viewed a house back in March, fell in love and my offer was accepted. I’m a first time buyer and there is no chain either side so believed that this would be an easy (ish) process. 

7 months later and still having issues. My solicitor found that the bottom of the garden was not legally registered to the owner 3 months into the process and the last 4/5 months have been filled with unsuccessful applications. 

The sellers solicitors are very unhelpful and have taken their time to complete anything that is needed so a lot of delays have come from this. 

They originally applied for the land to be moved into their name as they believed land registry had made a mistake with the boundaries. This was rejected and they put in an application for AP. This was then rejected as the land had not been previously registered. The put an application in for FR last week and it was expedited on Monday. Is there a timeline for how long this would normally take? My mortgage offer expires soon and I’m very anxious about this and have found the process very difficult. 

Has anyone had a situation like this previously? Is there any timeline? I really don’t want to pull out of the sale but I have been waiting a long time and don’t know what to expect moving forward.

  • Applications are moving very fast once expedited at the moment - I’ve had simple ones come through as completed before I even got the response telling me expedition had been approved! I would expect that a FR would take a little longer, and of course a lot will depend if any requisitions are raised.
