Hi all, sorry for the slow reply. Could you please check you're happy with the wording here & I'll submit my defence asap (this follows just below point 10 in the defence template)
"Please note the Defendant has recently changed address and politely requests all future documents pertaining to this claim are served to the below address:[my address].I, the defendant, believes that the facts stated in this defence are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.Signed, [my name]."0 -

- you can't just bury the vital new info about a new address for service in the defence. Nobody will read it and the DQ will be sent to your old address and you'll get a CCJ behind your back!
- when putting a defence in on MCOL you don't add a statement of truth or signature, as it is already implied and accounted for by you using the the online system to defend.
- you need to use the special Template Defence for claims where no breach is pleaded. The one talking about Chan and Akande case law.
It is linked twice in the Template Defence thread. Use that with no added info.
Then two things:
1. Email the CNBC case progression email and the litigation email for CEL (search the forum) to tell them the service address for the Defendant has changed to X and they must erase the old address (which was Y).
2. Please do the government's Public Consultation. We need every poster to complete this vital survey before the deadline next week.See this thread:
We understand that you may need some pointers. It looks laborious, we get that. It doesn't matter; no knowledge is needed except re your own experiences so you can call out a scam industry and you'll protect millions of motorists and help change the law.
I've written some guidance to help focus new posters on the issues. I've covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.
Ordinary people like you are falling victim to this scam 15 million times per annum. Motorists need your voice added please.
