Go through all the required stages of defending this and DCB Legal will discontinue by early next year.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Hi all, sorry for the slow reply. Could you please check you're happy with the wording here & I'll submit my defence asap (this follows just below point 10 in the defence template)

"Please note the Defendant has recently changed address and politely requests all future documents pertaining to this claim are served to the below address:
    [my address].

I, the defendant, believes that the facts stated in this defence are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.

    Signed, [my name]."
  • Can you post a copy of the claim form redacting personal data including VRM, password etc. but leave all dates showing.
See attached/below, let me know if I've missed redacting anything please. Thank you

No, I see why you added that but none of that is OK:

    - you can't just bury the vital new info about a new address for service in the defence. Nobody will read it and the DQ will be sent to your old address and you'll get a CCJ behind your back!

    - when putting a defence in on MCOL you don't add a statement of truth or signature, as it is already implied and accounted for by you using the the online system to defend.

    - you need to use the special Template Defence for claims where no breach is pleaded. The one talking about Chan and Akande case law.

It is linked twice in the Template Defence thread. Use that with no added info.

    Then two things:

    1.  Email the CNBC case progression email and the litigation email for CEL (search the forum) to tell them the service address for the Defendant has changed to X and they must erase the old address (which was Y).

    2.  Please do the government's Public Consultation. We need every poster to complete this vital survey before the deadline next week.

    See this thread:

We understand that you may need some pointers. It looks laborious, we get that. It doesn't matter; no knowledge is needed except re your own experiences so you can call out a scam industry and you'll protect millions of motorists and help change the law.

I've written some guidance to help focus new posters on the issues. I've covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.

Ordinary people like you are falling victim to this scam 15 million times per annum. Motorists need your voice added please.

    CLOSES ON FRIDAY 26th SEPTEMBER.

Brilliant, thank you. To clarify, the special defence template should go in point 3 of the general defence template correct? Or is there a separate full template I've missed?

"3. With regards to the POC in question, two recent persuasive appeal judgments in Civil Enforcement Limited v Chan (Ref. E7GM9W44) and Car Park Management Service Ltd v Akande..." (this one, right?)

I'll get on with emailing them re the address change asap.

I'll look at filing out that form when I get time, thank you for linking that.

I can't recall if the linked defence is a full defence TBH! But isn't it self explanatory?

    Hello all again :)

I don't know how to say this properly so in summery:

    • I messed up.
    • My D&Q was due 23rd February.
    • I completed this & sent the email on the 20th.
    • Didn't get a reply back but didn't think much of it, I don't know why.
    • Today I sent another email & got a pop up saying 2 messages in que.
    • The email I'd sent on the 20th had queued while the document uploaded and didn't send until I opened the outbox section of Gmail today (I've opened the app extensively the last week checking for other mail and it never sent or notified me, so again I assumed all was fine, silly to not double/triple check I know but here I am.)
    • I'd signed & dated the PDF on the 20th but I assume they won't be interested in that.

So I guess my question is what should I expect/do now? I checked MCOL and my case is still at the same state as before.

Thanks in advance, sorry I messed this up.
