Hi all,
I'm hoping for some guidance.
I'm the claimant in a civil case where a trades person has admitted part liability to my claim. However, they have not stated which element of the claim they admit to but in response, have offered a substantialy reduced amount of "compensation" based on their supposed monthly outgoings.
Quite frankly, I don't believe the figures quoted as their claimed income /outgoings. I can show they have misrepresented one of their answers (they claim not to have any outstanding CCJ's but they have several), so this leads me to believe their figures may also not be accurate.
How can I question this at the hearing and get them to prove their financial situation, as I am worried that if I win my case, the Judge may just take as fact their claim of only being able to pay X per month which will take several years to pay off the debt?

What they owe you ought to be a separate matter from any payment arrangement.1

How long will it take them to pay off, as that can be used. e.g. they offer to pay £10pm on a £10K debt.0
