Planning Permission Refusal and Permitted Development

We have had an email from the council saying planning permission will be refused for an air source heat pump (ASHP) at the side of our property as, we applied as it's close to our property boundary. The council seem to saying that if we don't withdraw the application and it is refused then we'll not be able to change the location  and put it in the back garden which would be Permitted Development.

Is it the case that if planning is refused that any Permitted Development for the same thing is forfeit?

    No. You would still have permitted development rights, unless these were removed when the property first got planning permission.

    I've made literally 100s of planning applications and reminding the planning officer of what we can do under PD rights is often good leverage.
