As everyone else has mentioned. Try complaining to Waitrose to get it cancelled first. But as also stated the PCN letter is not PoFA compliant meaning they are unable to automatically transfer liability for the parking charge from the alleged person who was driving to the registered keeper of the vehicle.
There is a template in the newbies thread which you can use when you appeal to the parking company. The very important bit is to not say who was driving at the time. So no statements like I parked the car or I go shopping there. Also most parking car companies try to trick you by trying to get you to fill in the details of who was driving. If there is a box asking for driver details just put N/A or none of your business. If you follow the advice given it will be very easy to get this cancelled.
Just use the below template given by LDast
"I am the Keeper of the vehicle and I dispute your 'parking charge'. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.
As your Notice to Keeper (NtK) does not fully comply with ALL the requirements of PoFA 2012, you are unable to hold the Keeper of the vehicle liable for the charge. Partial or even substantial compliance is not sufficient. There will be no admission as to who was driving and no inference or assumptions can be drawn. Britannia has relied on contract law allegations of breach against the driver only.
The Keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NtK can only hold the driver liable. Britannia have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN."4 -
Could I just a HUGE thank you for all the kind and helpful advice. You'll be pleased to know that the manager of Waitrose has cancelled the parking notice without hesitation when I explained the circumstances. I must have been really stressed as I was so relieved. It was almost the final straw in what has been a brutal year one way and another. A small thing to some people and normally I would agree but I guess I am at a very low point right now so it became magnified. I hope you all realise how much your replies have helped me - in more ways than just the obvious.God Bless xx6
