Employer did not notify me of a speeding offence

My employer did not notify me that I was caught speeding and gave the wrong address. I have a very toxic relationship with my employer. I’m currently looking for work elsewhere. I feel my employer has purposefully given the wrong address and chosen not to tell me in the hopes it would cause me money problems. Where do I stand? I read somewhere that it is an offence to inform an employee of a NIP, is that correct?

  • When the employer receives a NIP/S172 notice, their only obligation is return the completed notice naming the driver. I've never seen it written anywhere that the employee MUST be informed.

    If the employer responds to the S172 with a fictitious person or deliberately gives the wrong address then they can be prosecuted either for failing to comply with the S172, or attempting to pervert the course of Justice if the CPS feel that they gave the wrong details to help you "get off".

    I presume that they can say that they gave the (old) address that they had on file, and it is your fault for not informing them of your change of address?
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))
  • I presume they received a s172 as keeper (or after being nominated by a lease company), checked their records, and found the vehicle was allocated to you at the time of the offence. They then returned the s172, nominating you.

    Whether they tell you other than that is purely an internal HR/procedural question. They have no legal obligation to, or restriction not to.

    The question is what address they put for you, and how that address was given instead of the correct one. Was it a previously-correct address for you?

    I'm presuming that your apparent failure to return your own s172, due to that wrong address, is now coming back to bite you. You may have grounds to contest the failure-to-notify if the address had no realistic prospect of reaching you - but it will simply reset the clock, and you will still have to either accept you were driving or nominate a driver, as if it had reached you straight away.
