The prizes do not include:

Expenses beyond those mentioned are not included, such as travel to the airport or railway

station in the city of origin, or return journeys from the airport or railway station to home; or

meals outside those provided for in the prize details (snacks and dinners), as well as other

additional expenses not envisaged in the prize. Nor is a tourist guide in languages not shown in

the section "The prize includes" included. The rental car does not include the diesel/petrol

refuelling or electricity recharges necessary for travel. Private transfers and public transport are

not included if neither the winner nor the accompanying person has a driving licence.

Dates of enjoyment of the prize:

The prize can be enjoyed from 7 January 2025 to 30 April 2025, both inclusive. The Easter period

in Catalonia, between 11 April 2025 and 21 April 2025, both inclusive, is excluded.

The Catalan Tourism Agency and, where appropriate, the companies collaborating in this

promotion will not be liable under any circumstances for damages of any nature, direct, indirect

and/or circumstantial, whether immediate or deferred, that may appear on the occasion of or

as a result of the corresponding prize and/or draw. Participation in this draw entails the express

acceptance of this condition.

The prize of this draw is subject to the obligations required by current tax regulations, which

includes making the payments on account that apply in each case. To this end, before the prize

is enjoyed, the Catalan Tourism Agency will ask the beneficiaries to prove their tax residence

(for the purposes of the double taxation agreement).

The prize of this draw is subject to the legally established obligations and tax withholdings. The

Catalan Tourism Agency will issue a certificate stating the value of the prize and the deposit in

the account made.

Under no circumstances may the prize be exchanged for its cash value.

6. PARTICIPATION IN THE DRAW

People who wish to participate must fill out the form accessible from this link, hosted at

https://www.catalunya.com/en/catalonia-one-destination-5-trips filling in their personal

details.

Participants will receive a confirmation of their participation through the same participation

website.

Each participant will be assigned an identification code that will be used in the draw.

Only one entry per person is allowed in the draw.

No entries will be accumulated by registering more than once.

Any fraud or attempted fraud, in particular providing incorrect information or the falsification

of address or identity, breach of these rules or any attempt to tamper with the draw, will result

in the automatic elimination of the participant(s) involved and possible legal action by the

organising company.

A winner who hastampered with the draw in any of the aforementioned ways will lose the right

to receive their prize. The participants and, in particular, the winner, expressly accept and

consent to any actions aimed at verifying their identity. The illegibility, inconsistency or

falsehood of the identity or address of the participant will entail the automatic elimination of

their participation and the cancellation of the prize won.

7. PRIZE DRAW PROCEDURE AND ANNOUNCEMENT OF PRIZES

The draw will be held no later than 30 working days from the last day of participation in the

promotion (17 November 2024), among all participants who have filled in their data in

accordance with the provisions of these rules.

The draw will be carried out through the Easypromos platform following the mechanics that

appear at this link

The selection of the winners and alternates will be made randomly through the Easypromos

platform. Easypromos is a platform that guarantees the transparency of the result of the draw

and, as proof of this fact, issues a certificate of validity for each of its draws, the results of which

are unalterable by the organiser of the draw and/or any participating user.

The draw will result in five winners and five alternates.

The prizes will be assigned in order of the list of winners generated through Easypromos, in the

order of the prizes detailed above. In other words, the first person to win the draw will receive

prize no. 1 (section 1); the second person who wins the draw will receive prize No. 2 (section 2);

the third person who wins the draw will receive prize No. 3 (section 3); the fourth person who

wins the draw will receive prize No. 4 (section 4); and the fifth person who wins the draw will

receive prize No. 5 (section 5).

Notice of the result of the draw will be given to the winners no later than 5 working days from

the execution of the draw, through the email address provided in the form.

Each winner must accept the prize within 3 working days ofreceiving the prize notification email.

In addition, in the prize acceptance document, you must state the dates of travel and choose

the two experiencesto enjoy in the prize you have won. This acceptance must be communicated

to the organiser through the acceptance document that will be provided, which must be signed

and sent to the following email address publicitat.act@gencat.cat.

If, for any reason beyond the control of the Catalan Tourism Agency, the winners cannot be

contacted after the draw or they do not accept the prize, it will be understood that they waive

it and it will be passed on to the first alternate person, who must also accept the prize within 3

working days of receiving the prize notification email. It will proceed in the same way until the

five substitutes are used up.

If any of the winners withdraws, the prize that would have been theirs willskip to the first person

on the list of alternates, and so on up to a total of five alternates.

In the event that neither the winners nor the alternates have accepted the prize, a further draw

will be held with the rest of the participants on the same Easypromos platform and in

accordance with the procedure set out in this section.

If no-one is named as the winner of this second draw, the prize will be void.

The Catalan Tourism Agency will be released from any liability that may arise from possible

errors in the data provided by the favoured contestants, in the event that it is not possible to

identify them.

Award ceremony:

The prize will be delivered by the Catalan Tourism Agency no later than one month from the day

the winner notifies the Catalan Tourism Agency of the dates of travel and the details of the

beneficiaries.

Travel documents and reservations will be sent to the winner via email, along with the trip

schedule.

The prize is non-transferable. The use and enjoyment of the prize is limited to the winner and

the person expressly named thereby as their companion. In no case may the holder of the prize

assign it or exchange it with another person, nor may it be subject to compensation.

The winner will be entitled exclusively to enjoy the prize obtained as such and may not request

financial compensation for their withdrawal under any circumstances.

8. ACCEPTANCE OF THE RULES AND CLAIMS

Participation in the draw entails full acceptance of all the clauses contained in this document of

rules, as well as the express submission to the interpretative decisions made by the Catalan

Tourism Agency as organiser of the draw.

Complaints related to this draw can be submitted to the Catalan Tourism Agency, at the

following email address publicitat.act@gencat.cat,no later than 30 days from the closing date

of the promotion.

9. DATA PROTECTION

The Catalan Tourism Agency is responsible for the processing of the data of the participants

within the meaning of Article 26 of the General Data Protection Regulation.

With participation, the organiser will process the personal data of the data subjects in order to

manage their participation in the draw, as well as to manage the prize and keep them informed

of everything related to their participation. Furthermore, if the data subject expressly consents,

their data will also be used to send commercial offers and newsletters related to tourism in

Catalonia that the Catalan Tourism Agency may consider of interest.

To carry out the draw, to select the winner and the alternates, the services of the company

Easypromos are used, which acts as data processor and with whom it has the corresponding

regulatory agreement of its status as processor that is the legal basisfor it to access this data for

this purpose on behalf of the Catalan Tourism Agency. It may not use this data for any other

purpose.

The organiser may retain the data of the winners to the extent necessary for the fulfilment of

its legal obligations, or its functions, or to preserve its legitimate interests and in accordance

with the applicable filing regulations.

Participants can exercise their rights of data access, correction, erasure, portability, restriction

of processing and/or objection by contacting the data protection officer at:

lopd.act@gencat.cat. If you do not obtain a satisfactory response in the exercise of the rights,

you can file a complaint with the relevant control authority: Catalan Data Protection Authority

(www.apd.cat).

10. IMAGE RIGHTS

The Catalan Tourism Agency and, where applicable, the partner companies, with the winner's

prior consent, may reproduce and use the winner's full name and other information, as well as

their image, in any advertising/promotional activity related to the prize draw in which they

participated, and such use shall not entitle the winner to any remuneration or revenue or

benefit, except for the delivery of the prize they won.

11. LIABILITY

The Catalan Tourism Agency disclaims any responsibility in the event of illness, accident or any

other circumstance for which travel insurance is required. The prize includes travel assistance

with the insurer CASER and cancellation insurance.

The Catalan Tourism Agency disclaims any liability for any claim, loss, damage, cost or expense

arising due to injury, accident or death, damage, loss or delay of luggage or other property,

inconvenience, loss of earnings, danger or frustration, whether physical or mental, resulting

from, but not limited to: 1 - Mechanical breakdowns, government actions, strikes, forced

closures due to war, weather, acts of God, acts of terrorism or other factors beyond our control;

2 - Acts of vandalism, air, land or sea piracy, theft, accidents, fire, wounds, assaults or any other

physical damage to your property and/or person; and 3 - Your own fault for not following

instructions, including those relating to passports and visas.

12. RELEVANT LAW AND JURISDICTION

These rules are governed by Spanish law.

Any question of litigation that may arise in relation to the validity, interpretation and/or

application of these rules is expressly subject to the jurisdiction of the courts of the place of

performance of the obligation, which is the place of enjoyment of the prize.

Just a heads up if anyone is struggling to get the form to submit for this one - it kept saying 'this field is required' despite filling everything out and wouldn't submit on Edge or Chrome but worked when I tried on Firefox
