Hi we are experiencing damage caused by a neighbours property that is rented out. We have legal expenses cover attached to our home insurance. This leak has been present for over eight months the insurance company says as the op are engaging with them they won't pursue the case through the courts.
Has anyone been in a similar position? If so how was it resolved? I appreciate any advice offered

Thanks for the reply, they are engaging by doing patch repairs, the leak is coming from the roof of a property the op rents out.
I am considering pursuing an abatement order or an interim order that enforces her to place a waterproof membrane over her roof to prevent further damage to my property.

Thanks, I have contacted a roofing company and they provided a report, they know what the issues are and have informed the op.
The op has had several roofers there, however because of the condition of her roof they will not entertain repairing it. They have informed her that she needs a new roof and the gable end needs rebuilding.
I am eght months into the legal route. I was just wondering if anyone had experience with a similar situation and how they got it resolved.
Initially there wasn't scaffolding in place and her contractors were working off my roof and caused damage to tiles.
There is now a scaffold tower in place but no work being carried out.0
