I've been stung by Excel Parking...

After some advice here folks. 

I've been issued a FPN by Excel Parking Services. The circumstances being that on 18th September I drove into the city of Wakefield in order to meet my Fiance for coffee on her lunch break. I chose to park in the Providence Street pay and display which I've used before and chose this because I knew I could pay for it on RingGo, who carries change anymore? 

Anyhow, I enter the car park at 1135hrs and proceed to park. I then encounter trouble with the RingGo app which just refused to work due to poor signal. Because of this I remained sat in my car for 20 minutes until I could get the damn thing working and bought a ticket for 1 hours parking. So my parking started at 1155hrs and expired at 1255hrs. I then left the car park, had a delicious coffee and returned to my car and exited the car park at 1239hrs meaning I'd spent a total of 1 hours and 4 minutes in the car park and paid for 1 hours parking. 

On the 25th I received my FPN stating that I have failed to pay the parking tariff within the allowed time and that the contravention time was 1239hrs. 

I sent off an appeal, screen shots of my proof of purchase for parking and of course it was rejected. 

I'm going to go back and have a look at signage in the area so I can't comment on that currently.

So what's everyone's thoughts? I feel like I've been done over here after making a genuine parking purchase which was delayed due to rubbish phone reception. I even left the car park early knowing that id entered about half 12. One other thing is that allegedly the contravention time is noted as 1239, which surely isn't right given I paid my tariff at 1155.

 Have I got a leg to stand on here?

    You probably have 2 or more legs to stand on in any future court claim hearing 

    Meantime do nothing unless you receive a Letter of Claim or a court claim pack from the CNBC in Northampton using MCOL within the next 6 years 

    Meanwhile, do gather your own exhibits and keep them safe, along with the paperwork 

    Ignore any debt collectors letters

    Please clarify what the FPN is.
  • 101). FAILURE TO PURCHASE THE PARKING TARIFF FOR THE REGISTRATION MARK OF THE VEHICLE ON SITE WITHIN THE TIME ALLOWED. 

    Contravention date 18.09.24
    Contravention time 1239hrs. 

    I have also been to the car park. There are terms and conditions next to the pay machine and the time allowed to purchase a ticket is 5 minutes. The pay machines are broken and have paper signs on them instructing that mobile purchases are required. 

    Should i make appeal through the IAS?

    We don't recommend an IAS appeal, especially if no payment was made or was late 

    Surely you received a Parking Charge Notice. ?  a PCN. ?
