    i don't know who the other parties insurer was, don't remember seeing it in any documents

    As for registering the accident, has it got to be an insurer ie Aviva who does this or can the accident helpline do this? Aviva hasn't done it, so wondering who actually can.

    I dont know if we are talking cross purposes or such?

    A claim on an insurance policy will typically be registered by the policyholder or their broker. In an alleged fault claim then a third party may register the claim or a represent for them (eg solicitor, accident management company, their insurer etc). In this case the insurers first actions will be to try and contact their insured to validate the allegations. 

    It would be unorthodox for your solicitor or accidentment management company to try and register a claim on your policy.

    Ok so got hold of aviva finally and they haven't put a claim in, but they have checked the CUE log and one is registered on the date of the accident, but not by insurer at the time. 

    So not really sure where to go with this one, in the last 16month ive had a hire car, car written off and funds put in my bank account, and ongoing treatment. But i cant seem to find who has done all this. The solicitors have told me is was accident claims helpline who informed them to sort the claim out. So anybody got an help on this one?

    So it's what I proposed, when looking for the telephone number for Aviva Zero you googled and ambulance chasers like National Accident Helpline advertise on similar search terms of well known insurers. Sponsored links appear above natural search results so you called them not your insurers. 

    See a similar search for DL below and the two non-DL companies that appear above as sponsored links:



    They then sell pass your details to solicitors to deal with the claim on a conditional funding agreement and provide credit hire/repairs. Those costs are claimed directly from the third party insurer who will be the ones that have loaded the case to CUE.

    Ultimately it's a complaint to Aviva as you did at some point speak to them and it appears they told you it's "ok". Really they should have told you there is no claim registered.

    You will have signed paperwork with the lawyers, almost certainly it will have said about the success fee. I'm guessing you signed without reading it properly but in the ideal situation you'd have seen the 25% success fee then, asked them why its there when its under your Legal Expenses insurance and they'd have then had to have said it isn't under your LE cover. As that isn't what happened you're probably going to have to shoulder some of the blame/consequences.

    As to how is it legal? Well the better ones dont try to pass themselves off, as per the image above they're clearly marked as sponsored and at no time mention Direct Line. Companies frequently advertise on their competitors brand names because it's a cheap way of finding target customers. 

    Some skirt on the edge of rules and on the phone will sidestep questions as to if they are "Aviva" and if challenged will clearly state they never claimed to be your insurer.
