Letter to PPC DPO re: updating address

Hi. I'd appreciate any feedback on this email to the PPC's DPO before I send it.

--------------------------------------
In relation to parking charge notice number ****. Date 2020. Vehicle registration *****.

I write to request that you update details of-
1) my postal address. Please remove any previous addresses on file, both for yourselves and any companies/organisations working under your direction. My address for all correspondence should be - *********************.

2) my surname. As per the DVLA records for this vehicle it is **********************.

I have recently received letters dated *** and **** sent on your companies behalf by dcbl (Direct Collection Bailiffs Ltd). They refer to the above mentioned parking charge notice dated 2020 for which I have not previously received any communications.
Prior to that date I was living at, and the car registered at, ****************. On that date I was staying in a hotel due to covid restrictions while our new home was cleaned and aired. After that date I was living at, and the car registered at, the new address given above. We had a postal forwarding agreement in force with Royal Mail, this should have picked up any prior communications regarding this parking charge notice.

Please confirm when these actions have been taken.
------------------------------------

I will be writing to complain to the landowner and the restaurant manager, as per advice in the newbies thread.
I have no specific recollection of buying a parking ticket as this was 4 years ago, however I park there a couple of times a year and tend to pay in cash for parking. It feels like the parking system there has changed many times over the last few years! I do know that on that date we were staying in a hotel close by, it was sheeting with rain, so I drove myself and two young, tired and stressed children to the restaurant.

Replace request with instruct and important you use the word ERASE instead of remove.

Yep. Looks good though. Send it to the DPO at the toothless DRA as well.

An up date, probably for my own purposes....., thanks for your guidance on the Newbies thread.

    Letter of Claim received.

Response e-mailed (based on your template) copied below-

    Dear Sir/Madam

    Your Ref. ***

    Parking Charge ref: ***

    Your client: ***

I refer to your Letter of Claim dated 6th January 2025.

I confirm that my address for service - assuming you don't delay any claim by another FOUR years- is as follows, and any older address must be erased from your records:

    ******

I have already contacted your DPO re: the above.

The alleged debt is disputed and any court proceedings will be vigorously defended.

I have sought, and will continue to seek, independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017.

I note that the amount being claimed is likely to be hugely increased from the original PCN which the UK Government have referred to as "extorting money from motorists". I say likely as no original PCN was received either on the car or by post.

I have two main questions, and under the Pre-Action Protocol for Debt Claims 2017, I am entitled to specific answers:

    1. Am I to understand that the £170 demanded represents what you refer to as a 'Debt Recovery' fee? If so, is this net or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

    2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?

    Yours faithfully

I had an e-mail from someone at the restaurant that we visited. They have had the PCN cancelled!
