    Apologies for the delay in getting back.

    I complained via "paymyparkingcharge" as per the NTK as keeper but they said I cannot appeal as keeper, only the driver can and so did not give me an option to appeal to POPLA.
    Please show us that reply that unfairly denied you the right to appeal.

    We DON'T need to see yet another pic of Moorside's LBC! Search the forum. Find some threads like yours. Copy what they did.

    Please be advised, we can only process an appeal from the driver on the day.

    You can ignore everything you receive about this fake Penalty Notice. Have you reported Moorside Legal to the SRA yet? Just the threat of issuing a civil claim for debt for an alleged Penalty Notice issued under statutory law is enough to get them into a lot of trouble.

    Do you not understand that any Penalty Notice issued under railway bylaws can only be enforced by the TOC/landowner laying information before a magistrate and then convincing them to issue a summons. Moorside Legal nor SABA have any authority to do that and any threat to try and recover an alleged Penalty debt though the civil courts is illegal.

    At the end of the day, they can't prosecute a fake Penalty Notice and they can't treat it as a civil contractual debt.

    This is already past 6 months but I will revert to the LOC as per the advice from this forum and yes, will report them to SRA as well.

    CEO number "Null" on that notice to driver?!

    Saba have tried to bring civil claims in the past via a different legal firm, Askews Legal LLP trading as "Debt Claims Solicitors.  There are a few threads on here about these and it didn't end well for Saba.

    I actually attended one case directions hearing where the DJ (eventually) dismissed the case because they were being asked to rule on a criminal matter, although it took some convincing.

    But this one is a Parking Charge (not a Penalty Notice). Either way, they could not deny your right to appeal and you aren't liable as keeper on railway land.

    The NTK shows they added £27 at a stage where they cannot.

    In which case ignore everything about a fake PN. Just wait for the N1SDT Claim Form from the incompetents at Moorside Legal where they will fill to comply with CPR 16.4(1)(a) and you can use the defence that includes the Chan and Akande argument for the claim to be struck out at allocation stage.
