Double Dip PCN

So I get a PCN from Parking Eye for a double dip scenario, parking at The Range car park. I forgot to appeal, I went back to work after mat leave, got swept in the teaching and the appeal date went by. They’ve now sent me a letter before county court claim asking me to pay the new fine of £125 or to contact them through a reply form?

I have attached a diagram showing how my car entered the car park but left straight away. This is shown by the arrows in black labelled as A on the map. The ANPR systems did not pick up my car leaving straight away. 

I then went to collect my husband from My Lahore Restaurant as his shift ended at midnight. I have a message that I sent him at 23:58 saying “I am here” as an English transliteration of another language. I don’t have CCTV footage of my car being in the restaurant car park, unfortunately.  

When we left the restaurant, we entered The Range car park from the entrance which is an exit on the roundabout, this is shown by the blue letter B on the map. We did not remain on the car park and went straight out the other entrance to join. This is shown by the blue arrow on the map. 

I have also attached the section of the map which shows the proximity of My Lahore restaurant to The Range and how you can leave the restaurant, join the roundabout and come off the roundabout on an exit which brings you straight into The Range. 

What’s my best bet from now? On the 10th, I did contact PE via email to explain all this but they have a 10 day response time and today I got this letter before court…

    Tell them they must also log this as a formal data breach complaint, due to their failure to bother to check all ANPR images as the car twice entered and exited. A 'double dip' case means the DVLA data was obtained without reasonable cause because this was not a single parking event and PEye failed to do their much vaunted '19 human checks' to find the orphan images, before automatically harvested DVLA data illegally.
