Judgement for Claimant (in default) - BW Legal - Residential parking

  • Thanks again, and will do so re: holidays this time. Fortunately I don't have any more planned for a while....

I passed on the email with claimant consent to change the date and the court has responded to state that a N244 form + £119 fee (for application with consent) is still required. Plus, they also said "If the Claimant’s are in agreement to the hearing date being adjourned, their agreement will be required on a drawn Consent Order."

Consent Order is something I had not anticipated and don't really know where to start with it. Any advice?

Ask the C to supply it.

Hello all - just to update on this:
    • Successful in rescheduling hearing date - now scheduled for next week
    • Submitted WS + evidence by email last week for the 14 day deadline (thanks to all of the thread contributors whom came up with some great stuff to use as a basis)
    • Received claimant trial bundle which is massive - hoped they would discontinue but apparently not...!
I am pulling together my paper bundle now for printing and will drop into the court in-person on Friday. Could I just confirm with those more experienced here what the contents of this bundle should be? i.e. does it need to include my defence, WS and all other filings I've made to date? Or simply the WS and print outs of all the stuff I intend to rely on (case transcripts etc.)?

    Thanks in advance!

Not the defence. Just a WS and the usual exhibits the NEWBIES thread already lists.

  • Great - thanks, just wanted to make sure. And yes, have included the exhibits where relevant to case

Hi all - to update on this, hearing was last week and I am pleased to say that the judge found in my favour! Claim dismissed and some costs awarded. I have received the cheque in post from claimant solicitors too.

I believe the forum preferred phrase is..."Another one bites the dust!" :)

I will later note down some takeaways from the hearing and judge's feedback on this thread in case it can be of use to others in future. But for now I would like to say a huge thank you again to all contributors to this forum for all of the input and support... especially to @Coupon-mad. This is truly an invaluable source of help and information.
    Hooray!

Did getting to this stage cost you two £119 court fees for applications?  Did you get any of that money back, given the CCJ was plain wrong (court error)?

When you come back to tell us more, please edit your thread title to include these words:

    ANOTHER ONE BITES THE DUST!

    AND - IMPORTANT:

Please find time to send an email response to this vital (renewed for 2025) Call for Evidence:

    https://forums.moneysavingexpert.com/discussion/comment/81070874/#Comment_81070874

It closes IN 3 DAYS TIME.

Recount your experiences please. Attach a word document evidence sheet (the only format they accept).

PLEASE tell the CJC what parking firms are doing to consumers and bringing the county court service to its knees, AND HOW THE COURTS ARE GETTING THINGS WRONG, AND EVIDENCE WHAT HAPPENED TO YOU.

You are an important source of evidence to inform the CJC.

This caused you a CCJ. Prove it by attaching a word doc showing your CCJ and complaints made, and how much this cost you to defend a meritless parking claim that didn't hold any sway with the Judge and was dismissed at the hearing. Why are the CNBC propping up & giving a platform and cheap 'fake debt recovery' to rogue parking firms?
