Smart Parking PCN, Union Square, Aberdeen

Hoping someone can assist. I have read through the newbie thread but am struggling as to what currently applies in Scotland and the recommended course of action.
I was issued a PCN notice on my windscreen on 4/10/2024 at the College Street car park which is associated with the Union Square shopping centre in Aberdeen.
The PCN was issued by Smart Parking because I had no valid ticket on display.
I have used this car park several times previously with no issue. On this occasion I attempted, several times without success, to make card payments on both of the ticket machines on the level where I had parked. Time was moving on and my wife was becoming anxious as we had a reservation at a restaurant within the shopping centre where we were meeting my son and his partner. As I was unable to make a card payment and had no cash on me we reluctantly decided to take a chance with the car unticketed as we were running late.
After the meal and making purchases at other shops within the centre we returned to find the PCN on the windscreen.
I don't know if this has any bearing but although my vehicle registration was reported correctly, the make and colour quoted are incorrect.
I have not appealed to Smart Parking or contacted the Union Square management. Should I?

Definitely ignore Smart Parking, no keeper liability in Scotland yet
The keeper could make a complaint to get it cancelled, to the business or landowner, as keeper

I am in a similar position as VAMBO76. I got a windscreen PCN saying 'No Valid Ticket' I actually had a valid ticket and it was just that it has fallen into the footwell. So I appealed to Smartparking sending copied of the ticket and receipt with my reg number. They have rejected the appeal saying "our payment system confirms that no ticket was purchased for your vehicle registration". This is wrong. They now advise to appeal to POPLA. Is POPLA valid in Scotland. I also complained to Union Square who say they cannot do anything about it. It is annoying having paid for parking a PCN is still being issued for a petty thing of this not being on display. Will I stand any chance of appeal with POPLA or will this go to small claims court? This happened on 14.09 .0 -

If appealing to POPLA a PCN in Scotland, you can only do so as the driver. Providing the details of the driver is exactly what you don't do in Scotland at this time.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
