Horizon ASDA Farnborough Parking - Moving Overseas

Hi All,

  • I received a Horizon Parking Charge for parking at Asda Farnborough on 21 August.
  • Appealed it to Horizon on 09 September (before finding this forum and its advice) stating I was only the keeper of the vehicle but not the driver.
  • Rejected the appeal 09 September.
  • I have just returned from a period of overseas and after reading the NEWBIES threads I have since emailed Asda House to complain and have the option of appealing to POPLA by the 11th October (this week).
  • I understand that the PCN I received may by POFA NTK compliant (as other threads seem to suggest they have finally made it compliant) -
  •  https://forums.moneysavingexpert.com/discussion/comment/80985226#Comment_80985226?utm_source=community-search&utm_medium=organic-search&utm_term=ASDA+POPLA+horizon
  • If it is compliant then I believe my appeal rests on the grounds of no landowner authority and poor and inadequate signage only?
  • To also throw a spanner in the works I am selling the vehicle and emigrating back to Australia at the start of November (approx 4 weeks away). I have read that I should email Horizon and tell them that the address they got from the DVLA will have NO affiliation with me from November. Should I provide them with a postal address in Australia and what ramifications will this have on the PCN, now that I am moving back to Australia?

Thanks very much in advance,

I'd bung in a POPLA appeal attaching evidence of emigrating to Australia and encourage Horizon to withdraw from the POPLA process because the driver will not be named, and even though the NTK might be POFA worded they cannot touch you in Australia.  So they may as well throw in the towel now.

Update: I lost the appeal and at every opportunity have notified Horizon that I have moved overseas and therefore have no UK postal address. 9 times I emailed Horizon to tell them to remove my UK address from file, and they ignored me until finally having emailed them every couple of days, they finally replied and have said they will only remove my UK address from file if I provide them with my overseas address. Do you think I should just provide them with the overseas address? What is the worse that can happen? I just want to avoid getting a CCJ in case I do ever return to the UK.

    Thanks

Yes. Send them a copy of a utility bill. Tell them to erase your former address and replace with your overseas address (use those two words - they have meaning).
What is the worse that can happen?
For you, or Horizon? 😂. It will end once you prove your overseas address.
I just want to avoid getting a CCJ in case I do ever return to the UK.
That's not going to happen. You're out of jurisdiction. They can't sue you through the UK courts, living in Australia. Get yourself a cold tinnie and take it easy!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
