Euro Car Parks - Charge for using Petrol Station Car Wash

  • Euri Car Parks Petrol Station PCN for jet washing my car and refuelling.

    I received a pcn for exceeding a 30min Stay  at a petrol station. I was in a hand jet wash bay. I have the card transactions on my bank statement as I extended the minutes to complete. I then pulled into the fuel bay for refuel.
    I did not respond to pcn.  Much time has passed and now received a claim form, to which I entered a defence as I had no idea that I had  exceeded a 30 minute parking limit. I had not noticed a sign but there must have been a sign. I would not have thought it included the activity of car washing and refuelling. I had used this local petrol station many times previously.
    I entered a defence to Civil National Business Centre and the Debt collections company. I now have the N180 for Mediation and Small Claims Track with options for Determination without a hearing, by a judge reading the case papers and making a decision. Or opting to attend in person.
     Any info appreciated.

    Mediation is compulsory (2 minute zero-offer phonecall. Feel free to berate them to the mediators that you were using the bloody car wash and it's effing pathetic. You can't talk to them directly sadly).
    Yes to a hearing in person (99.9% chance it won't happen and they'll discontinue to just before)

    I eventually stopped going to that local petrol station.

  • Thank you for your letter of appeal. The details of the Parking Charge Notice are as follows:
    Parking Charge Notice Number: 88888663620 Date of Issue: 18/09/2024
    Vehicle Registration Mark: YN66RCV Time of Issue: 15:13:36
    The Site: MFG - Shell Rusholme

    Breach of Terms and Conditions:
    Your vehicle has overstayed the maximum
    time period allowed

    Having carefully considered the supporting evidence provided by you, Euro Car Parks (ECP) have
    decided to reject your appeal for the following reasons:
    • The Site is operated by an Automatic Number Plate Recognition (ANPR) system. ANPR
    cameras have captured an image of the vehicle registration mark YN66RCV entering and
    leaving The Site and calculated the duration of stay.
    • Parking at The Site is limited to 15 minutes. Your vehicle entered at 14:18:26 and exited at
    15:13:36 therefore was parked longer than the maximum period allowed.
    • Signage located throughout The Site clearly details the terms and conditions. On entry to
    private land, it is the responsibility of the driver to ensure all terms and conditions as detailed
    on the signage are adhered to.
    • Please be advised that it is the registered keeper’s responsibility to inform of the full name
    and UK serviceable address of who was driving the vehicle within 28 days beginning with the
    day after the notice was given. If the full amount remains unpaid, under Schedule 4 of the
    Protection of Freedoms Act 2012 (‘the Act’), Euro Car Parks have the right subject of the Act
    to recover from the keeper of the vehicle at the time it was parked so much of that amount
    which remains unpaid.
    • As you have not provided a UK serviceable address, liability has been transferred back to you
    as the Registered Keeper.
    The parking charge notice has been issued correctly and remains payable.
    Please use one of the following options below to make payment for the amount of £60.00:


    Looks to me like they are just trying to get the money out of me. I'll be honest I haven't yet requested the CCTV from the petrol station or sent a SAR because the way the manager argued with me last time over his broken car wash made me not want to see him again. Also, it feels like I am having to put in a lot of effort to defend myself from this nonsense. 

    I will now complain to the station and send the SAR. Is it fine for me to go on and appeal to POPLA before doing those two things? The internal appeal rejection was issued on the 1st November 2024.

    Just go through the motions... POPLA is likely to be a waste of time. Ignore the debt collectors and wait for your claim form to arrive. Defend as per the template. It really doesn't matter what you put in as your para #3 to be honest. In due course, after a few months they will discontinue.
