    Share Your Freedom Terms and Conditions
    1. PROMOTER
    1.1 The promoter is Scoot Boot, 4/205 Kennedy Drive, Cambridge TAS 7170, Australia (the Promoter). Information on the prize and how to enter form part of these official rules (the Official Rules).
    2. WHO MAY ENTER
    2.1 The Share Your Freedom Competition (the Competition) is open to individuals who are 18 years or older at the time of entry.
    3. ENTRY REQUIREMENTS
    3.1 The Competition begins on 2 October 2024 at 12:01 AM Australian Eastern Standard Time and ends on 29 November 2024 at 11:59 PM Australian Eastern Daylight Time (the Competition Period). All entries must be received by the Promoter within the Competition Period to be eligible.
    3.2 Participants must submit a photo of their horse and a written description of what freedom means to them in 150 words or less (the Entry). The Entry must be submitted via the official Competition page located on the Promotor’s website or via the method specified by the Promoter on its official social media platforms.
    3.3 Upon entering the Competition, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules.
    3.4 Participants may submit only one Entry. Multiple entries from the same individual will be disqualified. Any attempt by a participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, logins, or any other methods will void that participant's entries, and that participant may be disqualified.
    3.5 By entering the Competition, participants warrant that their Entry is original, does not infringe the intellectual property, privacy, or publicity rights of any third party, and has not been submitted in any other competition or won any previous awards. Participants further warrant that they have obtained any necessary permissions from any third party featured in their Entry.
    4. Prize
    4.1 The prize (the Prize) for the Competition is a trip for two (2) to Tasmania, Australia, including:
    • Return economy-class flights from the winner's nearest major international airport to Launceston, Tasmania (up to a maximum value of $5,000 AUD).
    • Two (2) nights’ accommodation in Launceston. The first night is on arrival in Tasmania and the second night is after an Overnight Ride package at Bakers Beach in Narawntapu National Park provided by Cradle Country Adventures.
    • Return transfers from Launceston to Bakers Beach in Narawntapu National Park.
    • A Parks Pass to enter the Narawntapu National Park.
    • Participation in an Overnight Ride package at Bakers Beach in Narawntapu National Park in Tasmania provided by Cradle Country Adventures which includes a two hour trail ride on day one, one dinner, one night’s accommodation in a twin share room at the Bakers Beach Homestead in Narawntapu National Park, one breakfast, and a 3 hour beach ride on day two.
    • One pair of Scoot Boots.
    4.2 The total approximate retail value of the Prize is up to a maximum of $6,700 AUD. The Prize is non-transferable, non-exchangeable, and cannot be redeemed for cash. No substitution of the Prize or any component thereof is permitted, except by the Promoter, who reserves the right to substitute the Prize (or any portion thereof) for a prize of equal or greater value if the Prize (or any portion thereof) becomes unavailable for any reason.
    4.3 It is a condition of accepting the Prize that the Winner must comply with all the conditions of use of the Prize and in addition, the terms and conditions imposed by Cradle Country Adventures including but not limited to completing a disclaimer prior to undertaking the Overnight Ride package at Bakers Beach in Narawntapu National Park in Tasmania, not exceeding weight restrictions imposed by Cradle Country Adventures and not consuming alcohol or drugs before or during participation in the Overnight Ride package (https://cradleadventures.com.au/terms-and-conditions/).
    4.4 It is a condition of accepting the Prize that the winner holds a valid passport or is capable of obtaining one before the specified travel dates and is able to acquire a visa to enter Australia.
    4.5 By accepting the Prize, the winner warrants that they are of reasonable physical fitness and are sufficiently experienced to undertake a multi-day horse ride.
    4.6 By accepting the Prize, the winner acknowledges that horse riding is a dangerous activity and there are risks involved in undertaking such activity which the winner voluntarily accepts.
    4.7 All expenses and incidental travel costs, not expressly stated in the Official Rules, including but not limited to: travel or transportation costs outside the specified flights and transfers; ground transportation; meals; incidentals; gratuities; passenger tariffs or duties; airline fees; surcharges; airport fees; service charges or facility charges; personal expenses and charges such as alcoholic beverages and internet usage; security fees; taxes; insurance or other expenses and costs not specifically mentioned are the sole responsibility of the winner.
    4.8 The Prize must be taken on a date which allows the winner to arrive in Launceston, Tasmania by 14 February 2025 AEDT to join the Overnight Ride package at Bakers Beach in Narawntapu National Park on 15 February 2025 AEDT and return on 17 February 2025 AEDT, with an option for the winner to extend the return date. If the winner is unable to travel during this period and if an alternative date is unable to be agreed upon between the winner and the Promoter, the winner will forfeit the Prize, and the Promoter reserves the right to select an alternative winner.
    4.9 The winner can extend their stay in Tasmania, subject to the approval of the Promoter, but this will be at their own expense, and the Promoter will not cover any costs or expenses incurred outside of those specifically stated in these Official Rules.
    4.10 The winner must obtain travel insurance, which must include coverage for horse riding, evidence of which will be required as soon as practicable after the departure date has been confirmed by the Promoter and communicated to the winner.
    5. WINNER SELECTION AND NOTIFICATION
    5.1 The winner will be selected by a panel of judges appointed by the Promoter, including the Promoter’s Brand Ambassador, Annette Kaitinis and Chief Executive Officer, Cheryl Gray. The winner will be chosen based on the quality, creativity, and originality of their Entry and how well it aligns with the Promoter’s brand values, particularly the concept of "freedom." The decision of the judges is final and binding, and no correspondence will be entered into.
    5.2 The winner will be selected on 5 December 2024, and notified via email and phone call using the contact details provided at the time of their Entry.
    5.3 The winner must respond to the Promoter’s notification within three (3) days of being contacted. If the winner does not respond within this time frame, or cannot be traced, or if the winner is found to be ineligible or otherwise in breach of these terms and conditions, or refuses the Prize, the Prize will be deemed forfeited and the Promoter, in its sole discretion, reserves the right to disqualify the winner and select an alternative winner amongst the remaining entrants.
    5.4 No compensation is payable if the winner is unable to use the Prize as set out in these Official Rules.
    6. MARKETING CONSENT AND USE OF ENTRIES
    6.1 By entering the Competition, participants agree to receive marketing communications from the Promoter. Participants can opt out of these communications at any time by following the unsubscribe instructions provided in the communications.
    6.2 By entering the Competition, participants grant the Promoter a worldwide, irrevocable, perpetual, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display their Entry (including any submitted photographs, descriptions, or other content) in any and all media, including but not limited to the Promoter’s website, social media accounts, and other marketing materials, without any fee or other form of compensation.
    6.3 Participants agree that the Promoter may use their name, likeness, and any statements made by them in connection with the Competition or the Prize for promotional purposes without further compensation or notice.
    7. GENERAL CONDITIONS
    7.1 The Competition is void where prohibited by law.
    7.2 The Promoter reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Competition in whole or in part, at any time, without notice, for any reason, including if fraud, technical failures, or any other factor beyond the Promoter’s reasonable control impairs the integrity or proper functioning of the Competition. If any of these events occur, the Promoter will endeavour to reschedule the Competition as soon as practicable.
    7.3 The Promoter reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Competition or to be acting in breach of these terms and conditions or in an unsportsmanlike or disruptive manner.
    7.4 The Promoter’s failure to enforce any term of these terms and conditions shall not constitute a waiver of that provision.
    7.5 In the event of any dispute regarding the identity of an entrant, the authorized account holder of the email address used to enter the Competition will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
    7.6 The Promoter reserves the right to request the winner to provide proof of identity, age, or residency to claim the Prize, the absence of which, within a reasonable period of time, or refusal by the winner, provides the Promoter with discretion to forfeit the Prize.
    8. LIMITATION OF LIABILITY
    8.1 The Promoter is not responsible for any technical, hardware, software, telephone, or other communications malfunctions, errors, or failures of any kind, lost or unavailable network connections, website, Internet, or ISP availability, or any other difficulties that may result in the inability to enter the Competition or to receive notifications from the Promoter. This includes any injury or damage to entrants’, or any other persons’, electronic devices related to or resulting from participation, uploading or downloading of any materials related to the Competition.
    8.2 The Promoter is not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, or unauthorized access to the Competition.
    8.3 By entering this Competition, all entrants agree to release, discharge and hold harmless the Promoter and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in the Competition or any Competition-related activities and the acceptance and use, misuse, or possession of the Prize awarded, except where such liability cannot be excluded by law. The Promoter is not liable for any costs incurred by participants related to entering or winning the Competition, except as expressly stated in these Official Rules.
    9. PRIVACY
    9.1 The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and Prize suppliers.
    9.2 By entering the Competition, participants agree that their personal information may be used for marketing and promotional purposes in accordance with the Promoter’s Privacy Policy, which can be found at https://au.scootboots.com/pages/privacy-policy 
    9.3 Participants have the right to access, review, update, correct or cancel any personal information held by the Promoter by contacting the Promoter at scootboot@scootboots.com.
    10. GOVERNING LAW
    10.1 These terms and conditions are governed by and shall be construed in accordance with the laws of the State of Tasmania, and any disputes arising out of or in connection with these terms and conditions or the Competition shall be subject to the exclusive jurisdiction of the courts of Tasmania.
