ECP Fine even though ticket purchased - Disputed and now letter from Debt Recovery Plus

Hi all,

I have read through the newbies thread but still slight confused and after some reassurance.

Parked in an Euro Car park, Ticket machines were not working due to there being an issue with phone networks in the area that day. Managed to get the machine to work after trying for around 12mins (Also tried on the app but again due to signal issues was unsuccessful) Paid for 2 hours came back and left with a few mins to spare of the time shown on the ticket.

A few weeks pass and a fine came through from ECP, which we disputed with them informing them of the above, they have said we did not pay for the amount of time the car had entered and left, informed them of the reason. Heard nothing back other than automated email back to the dispute. Unfortunately we filled out the dispute online so we have declared who the driver was.

A few months have passed with no response from them but have now had a letter from Debt Recovery Plus.

What would you advise at this stage?

    Post 4 of the newbies sticky thread, IGNORE debt collectors letters , they are powerless 

    Come back to this thread if or when you receive a Letter of Claim or a court claim in the post within the next 6 years 

    Update the DPO at ECP if you move address in the meantime

    We assume this was in England.

    Ignore them until you get a court claim which is when it ends (no hearing needed, nothing to pay).

  • We have a court date with ECP with them using QDR solicitors...whats the likelihood they wont turn up?

  • DCBLegal LOC has turned up dated on the 18th June, reason stated as "the P&D/permit purchased did not cover the date and time of parking". I have looked at Newbies thread and the template for response to them, does this apply here where we have already declared who the driver was? Thanks again.

  • Email response back from DCBL saying they are still proceeding as no evidence to back up our claim. "Strongly Advise to contact their dispute line" I assume I just await them to take it to court?
