Better to ignore or appeal

Options
Someone I know received a parking fine for staying in a Euro Car Park in Scotland for 28 minutes then leaving without paying. They parked their car then tried to pay using the app as they had forgotten to bring their bank card and had no cash. After 20 or so minutes of unsuccessful attempts to pay using the app they decided to move their car to another car park. They have since received the letter saying they will be fined £100, or £60 if they pay quickly. My question is: is it likely they can successfully appeal by explaining what really happened or should they just ignore the letter, or reply using the keeper liability tactic and say they don’t know who was driving the car?

    Why are you thinking of appealing a private PCN in Scotland where I thought drivers knew to ignore these, until the law changes?

    You certainly DON'T tell them who was driving. Clearly you ignore them if the retailers won't cancel it (which is your only step to try).   Otherwise, ignore it.

    Things will change for new PCNs (not this one). So this advice is only valid in 2024.

  • I guess they wanted to appeal as they think they genuinely don’t deserve the fine. They needed parking for 2 hrs to do an activity. They tried to pay, couldn’t manage it, then moved the car to another car park where they did manage to pay for parking. 

    So, just to be clear, they should just flat out ignore the letter and all subsequent letters if they come? Or reply saying they don’t know who the driver is and just try and nip it in the bud?

    To reiterate - make absolutely no contact whatsoever with ECP. You are dealing with money grabbers, not John Lewis or M&S!  ECP will have no sympathy or understanding at all. Leave well alone!

    As there is no fine there is nothing deserving or otherwise.

    As already advised tell the person you know to have nothing to do with the Private Parking Company.  Do not respond to them in anyway whatsoever.

    Easy.
