    The Template Defence is correct, albeit most cases never even get to a hearing.

    Letter received on 16th October from VCS informing me they're dropping ELMS.

    They aren't attempting ADR.

    You will get a Mediation call soon.  Do not offer any money but you know that from the first 12 steps which cover  all the basics.

    Is there any difference between a counter claim, and claiming for costs (x amount of hours at £19/hour (PD 46 para 3.4) under CPR 46.5)?

    A counterclaim costs a fee and isn't the same as your normal (free) right to ask for costs at a hearing.

    **UPDATE**

    Notice of Allocation to the Small Claims Track

    Following the 30 second mediation phone call I had in November, and a Notice of Transfer of Proceedings shortly after, I have now received a Notice of Allocation to the Small Claims Track and have been given a court date. I wonder if VCS will pay the £27 court trial fee before the deadline in a couple of months...
