1. The Cheez-It Online promotion (‘Promotion’) is organised by Global (as defined in the General Terms and Conditions). The Promotion will run from Friday 27th September 2024 to Sunday 3rd November 2024 on Capital Network, Capital XTRA and Global Player. Global is the Promoter. The ‘Promotion Partner’ mentioned in these Specific Rules is Cheez-It and the ‘Prize Provider’ is NDL. 

2. IMPORTANT: The Promotion is subject to these Specific Rules and the General Terms and Conditions which are available here (together, the ‘Promotion Terms and Conditions’). Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions. 

Details of the Promotion: 

3. To enter the Promotion, you must go online to the Promotion entry page which can be accessed either at www.capitalfm.com/win, www.capitalxtra.com/win/ or via the Global Player app. Once on the Promotion entry page follow the instructions, submit your cheesiest joke in no more than 300 characters and enter your details.  

4. Online entry will open at 17:00 on Friday 27th September 2024 and close at 23:59 Sunday 3rd November 2024. Please note you will only be able to access the Promotion entry page via the Global Player app between Monday 30th September to Monday 7th October 2024. Access to the entry page via Capital’s and Capital XTRA’s win pages  will be available through-out the entire Promotion. Entries received before or after this time will not be included in the Promotion. 

5. Entries deemed by us to be rude, offensive, defamatory, illegal or condoning dangerous behaviour will be removed from the Promotion. 

6. Bulk, automated, machine assisted, third party, syndicate or other group entries are prohibited and we will disqualify any entries (and withhold or reclaim any associated prize from you) which, in our reasonable opinion, appear to have used any of these entry methods or, for example (without limitation), entries or votes that have been made from the same IP address, email address, postal address, telephone number, or similar or entries which we, at our sole discretion but acting reasonably, consider to be suspicious or fraudulent. 

7. If we know or suspect you are trying to enter or have entered this Promotion by using more than one phone number or if we know or suspect you are using variations of your name, we reserve the right to disqualify any relevant entry(ies) and exclude you from this Promotion and also permanently exclude you from entering any of our Promotions. 

8. Within 7 days of the closing time of the Promotion, all eligible entries will be entered into a draw. One entry will be selected at random and the winning entrant will be contacted by one of our representatives via email or telephone on the telephone number with which you entered the Promotion. If such winner does not respond within 10 days from being contacted, they will forfeit their right to the prize and we shall be entitled to select another winner by another random draw. That subsequent winner must respond to the notification email within 7 days of the date on which they are notified, or they will also forfeit the prize.  

9. We and our Promotion Partner may publish and publicise your name, image, social media handle and/or profile picture, your nearest geographical location (for example, your nearest city, town or county) and your entry, unless you object to your and/or your guest’s information being published or made available. We also may refer to your and any applicable third party’s (for example a guest/travel companion) association with the Promotion and/or the prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion; subject always to our Privacy Policy and all applicable laws. 

10. In relation to winners (and runners up if applicable), you understand that we and our Promotion Partner may: (i) interview you and your guest(s)/travel companion(s) which we may film, photograph and/or record and; (ii) film, photograph and/or record, you and your guest(s)/travel companion(s) in connection with the Promotion, either by telephone or in person, and we may use such films, recordings and/or photographs for publicity and PR purposes in any and all media, worldwide, as often and for as long as we consider appropriate or desirable, in connection with the Promotion unless you object to your and/or your guest’s information being published or made available. We may also publish your and your guest(s)/travel companion(s) name, image, social media handle and/or profile picture. 

11. This Promotion is not sponsored, endorsed, administered by or associated with Apple. 

Eligibility: 

12. The Promotion is only open to residents of the UK aged 18 years old and over, and who are based in the UK at the time of entry. 

13. Entry is restricted to one entry per person; duplicate entries will be excluded from the Promotion.  

14. Only one name and telephone number may be used by you in relation to this Promotion. The use of multiple names, telephone numbers and/or devices is a breach of our Promotion Terms and Conditions and we reserve the right to disqualify your entry(ies) and you will forfeit your prize should we know or have reason to believe that you attempted to use or did use more than one name, phone number and/or device to enter this Promotion. It is also prohibited for anyone else to enter the Promotion using the same phone number including household members or friends.  

15. Before transferring any winnings to you we reserve the right to request Photo ID (such as your passport or driving licence) and confirmation that the telephone number you entered on belongs to you and proof of your home address (such as a phone bill with your name, address and telephone number on). You agree and understand that should you win a cash prize you may be required to provide these to verify your eligibility. If you fail to provide the requested information and we are unable to verify your eligibility, we reserve the right to withhold any prize from you.

16. One winning entrant will win a trip to New York for two people, including:  

      a). Return flights for two people to New York City, USA  

      b). Return transfers from the airport to the hotel in New York 

      c). 3 nights’ accommodation at a 4-star hotel 

      d). Cocktails and cheese tasting at Murray's Cheese Bar for two people  

      e). Two tickets to NYC observation deck, Summit One Vanderbilt  

      f). £1,000.00 spending money

17. Travel is subject to availability at the discretion of the Prize Provider. Travel and excludes Independence Day/weekend, Labor Day/weekend, Thanksgiving/weekend, bank holidays, Valentine’s day/weekend and school holiday periods, specifically the Christmas holidays, summer holidays, spring and autumn half terms and Easter in both the UK and USA.  

18. Prize includes return economy flights, all flight taxes and surcharges as well as one piece of checked baggage per person. A Saturday night stay is a requirement of your ticket. Subject to availability, departure airport used will be the winners nearest international airport that operates flights to New York. Please note, this may not be your closest airport. Unfortunately, a direct flight cannot be guaranteed. If you don’t hold a UK passport you may need a visa for this destination, and this should be arranged with the appropriate embassy. Although please note the cost of a visa of this kind isn’t included in your prize.  

19. Due to the ever-changing travel advice in relation to world events, we would advise that you look at all the information available with regards to the entry requirements of the destination you are travelling to, before selecting your dates. To understand the risks in a country, follow FCDO Travel Advice. You can find information online at https://www.gov.uk/foreign-travel-advice. It is your responsibility to comply with any requirements for entering the USA and upon returning to the UK. The Prize Provider cannot be held responsible for the winner not having the correct travel documentation or following any entry regulations.  

20. UK Passport holders travelling to the United States of America are required to have a valid ESTA (Electronic System for Travel Authorization) from the US Embassy. You can apply for this a minimum of 72 hours prior to travel although we recommend you apply as soon as your travel is confirmed. Please note that anyone without an ESTA will be deported from the US upon arrival without exception. It is the winner’s responsibility to comply with the ESTA visa requirements of the US. Approval is at the discretion of the US Embassy and the Prize Provider cannot be held responsible for this being rejected. Should the winner purchase their ESTA through a third party rather than the official site, the Prize Provider will only reimburse the actual cost of the ESTA and not any of the fees involved. Travellers that are normally eligible to the Visa Waiver Program who have visited Cuba on or after 12 January 2021 must request a VISA instead of an ESTA if they want to travel to the US If a traveller is found to have visited Cuba and does not have the applicable VISA, entrance into the US will be denied.  

21. Transfers will be private and not shared with other passengers.  

22. You will be staying in a 4* hotel, sharing a double room with en-suite bathroom on a room only basis. If you’d prefer a twin room, we will do what they can to secure this for you, but it cannot be guaranteed. Your prize stay also includes local taxes and resort fees for the duration of your stay which is payable locally to the hotel when you check-out. 

23. The winner and their guest can either enjoy snacks and cocktails or a meal for two people at Murray's Cheese Bar based on a £75.00 max per person allowance. 

24. Tickets to Summit One Vanderbilt are subject to availability at the time of booking. Opening times may vary throughout the year. One signature cocktail/mocktail is included per person. Features: Three levels of immerse art, two glass ledges suspended 1,100 feet above Madison Avenue, 360 Views of New York and a signature cocktail/mocktail for two at the top in the café or wrap around terrace. 

25. Spending money and restaurant allowance will be transferred directly to the winner upon confirmation of full and correct bank details. Transfers can take up to 5 working days.  

26. Travel insurance is subject to normal terms of acceptance. Pre-existing medical conditions may not be covered. No age restrictions apply. Should the Prize Provider be unable to purchase travel insurance on the winner’s behalf, a cash sum of £60.00 will be provided to the winner via bank transfer. 

27. All prizes must be claimed and booked by the prize winner within 12 months from the date of our initial correspondence with them. 

28. You understand that should you win a prize package that is made up of various elements you are required to redeem all aspects of the prize in order to keep the prize. For example, you will not be able to accept the spending money only. If you are unable to accept the prize awarded in full, we reserve the right to withdraw the entire prize package and select another entrant to play or win as applicable.   

29. You must, at your own cost, comply with all necessary checks, and/or tests required for travelling to and from and entering and exiting your travel destination/venue. This includes, but is not limited to, purchasing, organising, undertaking, recording and/or registering any required Covid-19 tests. We will not be responsible for any costs incurred by you in complying with this clause, nor will we purchase, organise, undertake, record and/or register any required Covid-19 tests.   

30. You must comply with all applicable rules, regulations and guidance relating to Covid-19, both in the UK and your travel destination/venue. We are not responsible for your failure to comply with such rules, regulations and guidance.   

31. You acknowledge and agree that, without limitation to the provisions of Clause 12 of the General Terms & Conditions, our ability to fulfil a prize and/or perform any of our obligations under the Promotion Terms and Conditions could be affected by an actual or threatened epidemic, pandemic, disease or quarantine and/or any corresponding governmental action, guidance and/or ruling (including but not limited to any Foreign, Commonwealth & Development Office guidance) (collectively ‘Covid Measures’).    

32. If due to any Covid Measures, we are unable to fulfil a prize or perform any of our other obligations under the Promotion Terms and Conditions, then we shall not be in breach of the Promotion Terms and Conditions.  In accordance with Clause 35 below, in these circumstances, we reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion. 

33. Any other costs and expenses which are not specifically included in the prize description are excluded and will be the sole responsibility of the winner. By way of example, without limitation, transfers from the winner’s home to/from their UK airport are not included in the prize. 

34. The prize is non-transferable and non-refundable. No cash alternative is available except at our sole discretion. 

35. We reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion.

Your personal data that you provide to us will be collected and processed by us, our licensees (including Communicorp UK Limited) and our Promotion Partner as well as the prize providers, and if applicable, our service providers, network operators and suppliers in order to administer and fulfil the Promotion. Your personal data may also be disclosed to the Phone-paid Services Authority, Ofcom and/or the Advertising Standards Authority at their reasonable request for regulatory purposes, for example, in order to prevent, investigate and detect crime, fraud or anti-social behaviour and comply with law enforcement agencies and applicable advertising codes. 

38. By entering a Promotion, you acknowledge that any personal data provided by you in connection with the Promotion will be processed as set out above and in accordance with our Privacy Policy which sets out full details of how we process personal data and how you can exercise your rights as a data subject, and our Promotion Partner’s Privacy Policy. Please ensure you have read and understood our Privacy Policy and our Promotion Partner’s Privacy Policy before entering any Promotion. If you are required to submit a guest(s)/travel companion(s) personal data to enter a Promotion, you must ensure that your guest(s)/travel companion(s) have given you consent to provide us and our Promotion Partner with their personal data. 

39. You may be asked if you want to opt-in to marketing from us and/or our Promotion Partner when you enter a Promotion. If you choose to opt-in, we and/or our Promotion Partner will use your personal data for marketing purposes (see Global's  Privacy Policy and our Promotion Partner’s Privacy Policy for more details). You can withdraw your consent to marketing at any time by unsubscribing.  

40. We, our Promotion Partner and the prize providers may transfer and process personal data outside of the EEA and UK for the purposes of administering the Promotion. Where any transfers are made outside of the EEA or UK we and the Promotion Partner will ensure appropriate safeguards to protect your personal data are in place.  

41. When you enter a Promotion we will retain your personal data for up to three years for internal purposes and to comply with our regulatory obligations. You may request the erasure of your personal data by emailing privacy@global.com. If your data is erased prior to the conclusion of a Promotion, you will forfeit your right to enter the Promotion and/or claim any prize and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable.
