Yes you cite CPR 13.2 and 13.3 as explained in the NEWBIES thread set aside section.

  • Hi all,

So a quick question on this. I submitted the N244 a few weeks ago and I've been told they respond within about 6 weeks which is fine. However this week I had a letter through from a bailiff threatening to take further action if I don't pay them the specified amount. (Incidentally the first time they got my address right). When I spoke with the court they said that there was no enforcement action logged against this claim.

Is this a usual thing that happens? And what happens if they do raise this with the bailiffs before I hear back from the court?

No bailiff will come knocking if the CCJ is for a single PCN (under £600).  No danger.
