  • Brilliant! I’ll add the to the template and email it. Do I need to print and sign it or is electronic signature ok. 
    It’s been really reassuring to know that it will most likely be discontinued.

    E signature is ok, no problem 

    I would not be printing, signing and scanning a document, just add a picture or scan of your signature, black pen on white paper. ( Although printing your full name should be ok too. )

    So personally I would type my name AND add an e-signature scan too , as I described in the last sentence ( other methods are available, other members here may differ or disagree, or they say that typing it may or will suffice. )

    just had a letter from DBS asking for evidence regarding me being vulnerable within 14 days from 22 October. 
    I’m assuming by vulnerable they are referring to - me being pregnant at the time, with undiagnosed depression and ADHD.
    while I can obviously provide evidence for those things, since it’s all true. I want to know if I HAVE to provide it at this stage. Especially considering it may not even go to court. 
    Also think it’s a very short amount of time - 14 days from letter date to be requesting such information. 
    Also very vague letter as to what they are referring to and I don’t like that I have to call someone to find out what they want - so no paper trail. 
    Am I just being paranoid and this is standard procedure? 
    Please advice, thanks in advance

    I suspect that you mean DCB Legal. ?

    You don't HAVE to provide it, but not doing so at this early stage could be construed as unreasonable behaviour, as an LiP you have a duty to narrow the issues, plus they may discontinue on receipt of the information requested 

    Personally, I believe that you should provide the evidence, because you would have to do so in your WS bundle in a few months time, next year 

    I wouldn't call DCB Legal, just email them the information, the same requested information that would be in your witness statement bundle 

    But, its your choice

    Don't give them anything. They are going to discontinue anyway.

    It is not "unreasonable behaviour" to not give them sensitive personal information at this stage. If they pay the trial fee and the time comes to submit a WS, then you can provide the information.

    Bear in mind they will pore over your submission to try and pick holes and try to prove you are not vulnerable. 

    It's a Catch 22 scenario from Sarah Ensall's point of view if you respond. She doesn't go to work every day with the intention of helping people.

    I’ve decided against supplying evidence for now. 
    If the case goes to court then I will supply the evidence. 
    Should I email to say this to DCB or just take no action, but keep documents ready in case I’m enforced to share them? 

    I’ve got a letter of diagnosis for ADHD and I’ve got my baby’s birth certificate to prove I was pregnant. I haven’t got a GP letter saying I’ve got depression and actually at the time I wasn’t officially diagnosed for depression anyways.  
    But quite frankly I don’t wish to provide private medical information to DCB unless I absolutely have to.

    Ok, in that case you either ignore their request, or you reply by email stating that

    "the information will be provided in my Witness statement bundle as will be directed in a future court order, as is the normal practice in litigation "
