Pot Hole Claim Lincolnshire County Council

Back in July I hit a pot hole on a road in Lincolnshire. I reported the pot hole that night and it was repaired within a week. 

I sent a claim in to Lincolnshire county council for two new tyres which had to be replaced due to damage from the pot hole (I was aware of one being damaged on my inspection but at the garage they advised me I needed both replacing as a result of the pot hole - this was detailed on the invoice)

Today I have received a letter from Lincolnshire Legal services stating that in agreement with the councils insurers the claim has been referred to them and I won’t hear anything for a minimum of 3 months. 

Is it normal for the claim to be referred to legal services? Everything I’ve read online says most claims are just rejected or accepted. 3 months is a long time for the amount I had to put on my credit card! 😖

    What would you prefer, an outright rejection or waiting a few months in the hope LCC's insurers may pay up?
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    I would hope I got paid, but I wasn’t expecting a letter from a legal service. 
  • If it’s anything like Manchester was/is .. they only pay if the hole has a ring around it and reject any other as not known about .. so a referral sounds slightly more positive

    You're aware that most claims fail yes?

    Yes it's normal for them to hand the matter to their insurers/ "legal services", it's what they pay them to do. Their insurers will also be much more credible when they tell you that if you continue with the claim that it will be logged on the CUE database and that they will check with your insurers that you've told them about the incident and aren't tempted to commit fraud.
