Goose Green Car Park Altrincham

We have just received a Parking Charge Notice from Smart Parking.  They say we stayed too long for the amount we paid.

Their ANPR shows time in the car park of around 1hr 20 mins.

My wife no longer has the ticket she bought, but my credit card bill shows she paid £1.80.

Their website conveniently doesn't show their tariffs on the tariff page - seems to be a load of error codes on it.

Parkopedia says £1.80 buys you three hours of Parking.

Does anyone have a recent photo of the tariffs at the car park itself?

And any advice on disputing this?  Is it a simple case of showing them a copy of the credit card transaction?  I've read that they are pretty underhand.

    Study the newbies sticky thread first 

    Study the NTK PCN letter, chances are that it fails to comply with POFA 2012, so no keeper liability 

    No blabbing about who was driving or about the incident itself 

    The keeper appeals using the typical Smart Parking no keeper liability template as seen in other recent Smart parking threads

    Add a one liner stating that the driver paid the tariff on the day so no breach occurred, so cancel 

    No explanations, stories, excuses etc, no inferring who was driving, the keeper appeals as keeper, using the no keeper liability under POFA angle 

    In future, keep receipts for several months

    You don't need ANY of the above and PLEASE stop the driver from appealing telling the story of what happened!

    As registered keeper, the recipient of the postal PCN has 100% win guaranteed just by using the usual words you find on other Smart Parking threads in 2024.

    Search the forum.

    Copy an appeal that points out the PCN is non-PoFA worded and the driver will not be named.

    The keeper cannot lose.  Such an easy one.  You got lucky as long as the DRIVER doesn't appeal talking about what they did.  No attaching bank statements.

  • Thanks for your replies.  The car is on a lease and the lease company have told them I am the hirer.  Does this change which template I use or the approach I take?

    You should have mentioned that in the first place 

    The hirer appeals it based on the same reasons, no hirer liability due to Smart Parking failing to comply with POFA 

    The bottom of the first post in the newbies sticky thread deals with hirers, using the Edna basher template 

    At no time is the driver revealed nor is there any stories about what happened, so that aspect doesn't change, Smart Parking have no idea who was driving so keep it that way, because they will not have complied with POFA 

    I doubt that the NtH complied with POFA and Smart Parking won't have included à copy of the hire or lease agreement, hence they will have failed to comply with POFA

    Why not just use the specific hire / lease and company car appeal by Edna_Basher that you saw when you read NEWBIES PLEASE READ THESE FAQS FIRST.

    Thank you for your replies - I've read the newbies post, but there's an awful lot to take in!

    I have received a copy of the PCN from my lease company and they have shared with me a copy of the letter they sent to Smart Parking advising that I am the hirer, along with my name, home address etc.

    Should I wait until I receive a copy of the Notice to Hirer before sending my appeal email?  Or can I just crack on with it now?

    In terms of the templates, from what I can tell, this one appears to fit the bill (but obviously replacing the references to the correct parking operator).  Is that correct?

    Dear Sir,

    Parking Charge Notice [0123456789]: Vehicle Registration [AA11ABC]

    I refer to the above-detailed Parking Charge Notice (“PCN”) issued to me by Highview Parking Ltd (“Highview”) as a Notice to Hirer. I confirm that as the hirer of this vehicle, I am its keeper for the purpose of the corresponding definition under Schedule 4 of the Protection of Freedoms Act 2012 (“POFA”) and I write to formally challenge the validity of this PCN.

    You will no doubt be familiar with the strict requirements of Schedule 4 of POFA to be followed in order for a parking operator to be able to invoke keeper liability for a Parking Charge. There are a number of reasons why Highview’s Notice to Hirer did not comply with POFA; in order that you may understand why, I suggest that you carefully study the details of Paragraphs 13 and 14 of Schedule 4 in particular.

    Given that Highview has forfeited its right to keeper liability, please confirm that you shall now cancel this charge. Alternatively, should you choose to reject my challenge, please provide me with details of the Independent Appeals Service (POPLA), their contact details and a unique POPLA appeal reference so that I may escalate the matter to POPLA.

    Thank you for your cooperation and I look forward to receiving your response within the relevant timescales specified under the British Parking Association Ltd Code of Practice.
