hi people,
I took my daughter to a concert last week in Birmingham. Melanie Martinez. She purchased a dress for £210. (Don’t get me started on the price!! 😆)

On getting home the shoulders are have come away from around the arms.
I have contacted their merch store and their response was all sales are final on the day but you can have 10% off your next purchase.
I have replied quoting the Consumer Rights Act 2015…
is there anything else I can do? Or am I wasting my time?

How did you pay?
They're talking rubbish and trying to fob you off.0 -

Given they are an American artist, where is the merchandise company based? Are you sure the firm you contacted is the firm you bought from?
In the UK, unless you agreed to other terms (possibly) then an in person sale would be governed by UK law which means the CRA applies and so they'd be liable for faults. However, if it's a US company they may be unaware of English Law and enforcing rights against them may be difficult. If you paid by card, and in particular credit card, then more options open but it will depend somewhat on if you hope for it to be repaired or returned for a refund.0 -
Is this a new dress (made in bulk and sold to fans to wear) ? Or is it an item of artists clothing that is being sold as memorabilia?
Your position is different depending on which it is0 -
Hi there,
Thanks for replying. It was a general mass produced item.My daughter paid using her HyperJar account - I think it’s Mastercard?Yes she’s an American artist, the online merch store I contacted appears to be based in Nottingham - it’s a general merch company. Problem could be that the online merc & the one at concerts are not the same company.
Could see no dress for sale on the online merc section.Life in the slow lane0 -
Did she put the dress on and wear it (even over whatever she was wearing that day) at the concert and then dancing at the concert?
It is just, that seam that has come apart sort of rather looks like the dress suffered from an over-stretch during a dance move of some kind.
That could certainly be a line the supplier follows.
I know this does not help, but I always take the view that "merch" purchased at events is over-priced low-quality product intended to have a limited life of at the event and little more.0 -
Does look like it ripped due to stretching.1
