    @shirleytch so you currently own the property jointly in your own names? Joint tenants or Tenants in Common?

    You need to understand that if mum transferred the house to you and your brother nearly 20 years ago, and he has lived anywhere else in the last 20 years, he has a CGT liability, even if he lives there now.

    It would have been much better if the property had remained in mum's name as her CGT liability died with her.

    At very least you and your brother need to meet a STEP solicitor to clarify ownership and sort out wills if needed.

    Rent out your half, see how he likes that if he won't sell!  I have heard of companies that could buy your interest in the house from you, not sure how legitamte that is though.

    These arrangements can seem to be a good idea at the time, but it always seems to be that the resident sibling holds all the cards and the other is just left hanging, with no access to their half of the asset value, whether gift or inheritance.

    The OP would not be resident, so the person is the second room cannot be a lodger. And the OP need to comply with lots of regulation and taxes or risk fines etc.

    The brother cannot be the LL to a lodger because he is in receipt of benefits and benefit fraud ain't  good idea.

    Moot point as apparently a lodger is not acceptable but my understanding is UC is not affected by having a non-related lodger
