30 day refund timeline query
Options
Hi there,
Tried googling/searching but my search terms havent had any luck! 30 days runs out on Friday, if we confirm we wish to claim on that, can it "happen" after 30 days? - Is being notified within 30 days enough, and the refund happens the week after for example.
Or does the actual exchange and refund need to happen within 30 days and when Monday comes around they can claim it is too late, where then we have to go down the repair opportunity route.
A short background, we feel we have a very obvious claim due to major existing faults found. Raised 1 week after bought, told to get a report from local garage which we did and was provided to them in week 2 - now 2 weeks later after emailing/calling every day and promises for managers to call us back etc to tell us the next steps we have been told they now want to have their own approved independent garage agree the faults (pretty understandable but that could have been told 2 weeks ago and had been looked in by now), but can only fit us in next week
We've been told "not to worry, if we agree with the refund, you've notified us within 30 days". And as they say, never get legal advice from the other sid, so there is a worry at that point they will say refund is not possible and we have to explore other routes.

YOUR REQUEST for the refund, under the short term right to reject, has to be within 30 of taking delivery/ownership of the item.

Is the OP claiming under "short term right to reject" (consumer rights) or under an exchange plan offered by the Dealer? Our local garage offers some marketing spiel such as "drive away happy, 30 day exchange guarantee". The latter can have any conditions that the Dealer applies. The former is as set out in legislation.0

@Tommyjw - what "30 days" are you talking about?
If you are talking about the 30 day short term right to reject under the Consumer Rights Act 2015 (legislation.gov.uk), then all you need to do is to inform the seller within 30 days of you taking delivery of the car that you are exercising your statutory short term right to reject within 30 days for a full refund. The refund does not have to be paid within the 30 day window, but should be paid without undue delay, and in any case within 14 days of the seller agreeing that you are entitled to a refund.
Note that when exercising this statutory right you need to establish that the car is faulty.
(Doesn't sound like this bit applies to you, but note that if you have agreed to a repair or replacement by the seller, then the 30 day window is paused until the repaired item or replacemnt is delivered to you).
If you don't mean the statutory 30 day short term right to reject, but you mean some other "deal" offered by the seller, then the answer to your question depends on the T&Cs of the deal offered by the seller.
Note that if you haven't exercised the short term right to reject, but you still have time to do so, then you should consider doing that0
