LG’s suggestion is obviously ridiculous. Given the thin and large construction of TVs nowadays, anyone who did this would be taking a massive risk of damaging it themselves, when they could only check for physical damage (of which you have confirmed there is none.) So it would have achieved nothing. Also, aren’t most Argos stores now a tiny space inside a Sainsbury’s?I suspect Argos might be trying to use the delay to wriggle out of this, but your argument will be that you could hardly have turned it on on arrival given that you’d have had to fit a stand you weren’t going to use in order to do this. Maybe Argos should be clear on their website as to what bracket is required, and you’d have had one ready and known straight away that there was an issue.
As you paid on Credit Card, the card are jointly liable with Argos under Section 75. But they’re likely do a chargeback instead as that would get the money from Argos’s bank rather than their own pocket, which would then have Argos contesting/potentially closing your account/trying to recover the money.You should follow housebuyer143’s advice and exhaust all possible routes with Argos first. I believe Section 75 has a longer timeframe than a chargeback, but others that have used them may advise further.0 -
I suspect the OP has been ‘too chatty’ , no need to tell them it was unboxed, tried , re-boxed while a suitable bracket was bought , then it was discovered that the TV didn’t work …just say after unboxing you decided it wasn’t the correct TV for you ( that’s an acceptable reason to return it ) or if you need to be ‘upfront’ , simply say it’s never worked , if it’s within 30 days of purchase their own policy states replace or refund.2

My son too has bought a tv through Argos click and collect (as they don’t deliver to his area.!) he got it home, set it up, switched it on and found the screen was cracked. Took it back to Tamworth Argos where he bought if from, they refused refund stating that the box was not damaged so he must have dropped it when setting it up, which he didn’t. Basically calling him a liar in front of other customers. He phoned their care line who said there is no problem he was entitled to a refund. So he took it to Nuneaton Argos, yet again got refused refund or replacement. He told them they were in breach of the consumer protection act, not selling a product fit for purpose. They were not interested, just said he must have dropped it as the box was not damaged ! Surely it could/must have been damaged while it was being packaged? . When he got home he remembered the dog cam would have been on so would have recorded him coming in with the tv and setting it up. He checked his dog cam, sure enough it showed everything from him bringing it in setting it up and switching it on. At NO point does he drop the tv. We have now emailed Argos head office complaints dept WITH the dog cam video, proving he didn’t drop it asking for a full refund. We as yet have heard nothing from them. How long should we wait for a response? What should my sons next steps be? He cannot afford to loose £400 he paid for the tv.0
