Bulk litigators - Mega whinge

The Commercial Court Users Association which represents the usual ambulance chasers on here, have been moaning to the MoJ that the current court system is so unfair on them. Their latest request for 'reforms' is in the link below but TD:LR they want:

a) Court bailiffs out of the loop and private HCEO types to be able to collect amounts less than £600.

b) They want more information from the judgment creditors so not just income and expenditure details but also assets held - so they can 'helpfully' decide if it is worth pursuing the debt by other means.

c) They want HMCTS to stop being helpful by explaining how to set-aside judgments and calling debtors to check if they can afford to pay the amounts.

etc....

Lastly one for the legal nerds. The claim there is a 'hole' in the CPR where a partial admittance of a debt which is not supported by a written defence, leaves the creditor in limbo as there is no mechanism for them to decide whether to pursue it further or not.

  • All land is owned. If you are not on yours, you are on someone else's
  • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
  • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
  • All land is owned. If you are not on yours, you are on someone else's and their rules apply.

    Is that different to "TLDR"?

As for suggestion(b)-would that apply to counter claims against the claimant?

    Quite a wish list
I can not see that happening and if anything does change it will take a very long time

Seen them lobby for that before - they want to be able to use HCEOs for debts under £600. DCB Legal and Empira, etc., would absolutely ruin people.

The CCUA is quite clearly ONLY representing Claimants in every submission I see from them.

The name is not suitable for that organisation.  They come across more as the Civil Bulk Claimants' Association and they should damn well admit who they really are.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Totally agree with C_m their name is completely unsuitable and misleading for stupid people like me. Having no knowledge of what this association did I thought from their title it was along the lines of a representative supportive body for all persons using the court processes. They represent a particular group of people only.
