Mis sold car insurance

Hi, Here goes......

So, i took out car insurance for my daughter in June 2024 as a provosional licence holder and when she passes ring them up and it will seemlessly move onto her full UK licenece.Although it was alot more £1600, I thought this would be good instead of paying around £300 for provisioanl insurance, then having to find another insurer when she passes her test.

Yesterday she past her test so rang up the insurance company and they said the underwriteers NOW said its too much of ab rsik to insure her so can't move her onto a FULL UK licence holder policy!!!!!!

At NO point was this ever mentioned to me about re-evaluating when she passes and was sold the policy stating it would move straight over when she passes...

Surely at the time we took out the policy all checks were done and no issues were there...

Can anyone please help as they've said i've got to cancel the poicy and loose £500 for the 3 months insurance we had??!!

Insurers are entitled to change their underwriting rules, they generally will honour the policies already in force but won't offer renewal terms etc. A Mid Term Adjustment is judged against the pricing/rules etc that are in place at the time the adjustment is made not the inception of the policy so yes things can change.

Ultimately you won't be able to force the underwriter to accept the risk however an appropriately worded complaint to the seller should hopefully get them to cancel the policy based on a basic time on cover without cancellation fees and/or increased "short term" rates given they didnt advise that the change would be subject to acceptance

Now that your daughter has passed her test, this is a change to the insurance cover.  Whenever these is a change you insurance cover, on any policy, the insurers can review the underwriting.
You daughter, as provisional driver, has already had three months worth of insurance and it is standard that she is being charged for this.
  • Thanks for your reply…

I’ve requested to cancel the policy now, which they have accepted but still want to charge me over £500 for the 3 months.

I’ve also asked for the original conversation with the advisor which will confirm at no point was this possible change happen.

Let me know your thoughts please.

Ask them for a breakdown of how they've calculated the £500

What was the annual premium when you bought it? Are you paying in instalments or paid in full up front?
  • Annual premium was £1600 paid in full

So you've had it a quarter of the time so expecting a charge of around £400 - the difference could just be their cancellation fees which is why you should ask for a breakdown of the charge. You've no argument against time on cover but you do have one for fees given they gave you incomplete information

which broker/ insurance company was this?

from past experience , the higher cost for a provisional driver does usually mean it will cover when passing for no extra rate - however one caveat was that you could not book the test within a certain period of time. maybe this is the case here?

  • Direct line was the insurer…

I’ve looked at the policy documents and it doesn’t mention anywhere regards time frames etc.

Really appreciate everyone’s help on this

Sounds just the same as Bike ins. Where many companies cover learner, but as soon as test is passed underwriter will not cover any change to a larger bike, as that is not their market.

Sadly if DL are not prepared to offer cover by their underwriter, for the fact test has been passed, not a lot you can do.
