  • You implied that at least one of the statements I made was wrong. I'd like to know which it was if so.
    I said I agree that he is the owner and is responsible for the sale of the property. He's then responsible for paying the proceeds to the estate (apart from his own share). He's not responsible for probate or distributing the estate. Until now, it doesn't sound like he has done enough that's clearly wrong enough to mean that the executor solicitor has failed to do what's necessary to warrant a complaint against them.

    i apologise if it came over that way.  It seemed to me that the power that the surviving T i C has was not sufficiently  emphasised in your post.

    I'm sorry I wasn't clear enough in my post. I was trying to point out that there are two completely separate issues: the sale of the house and the distribution of the proceeds. The partner is completely in control of the first and nothing to do with the second, I believe. So unless and until he doesn't pay over the proceeds to the executors, there's nothing untoward has happened.
    Not that I wouldn't be very worried about the way things are going in the same cirumstances!
