hello,
so long story short. my DRO application was approved 2 weeks ago. I know show up on the insolvency register. my poor Mum lost her battle to cancer a month ago and due to funds in her bank account my dad is now having to apply for probate (all the normal stuff). my parents were unaware of my debt situation. in order for my Dad to get probate his solicitor needs to check to make sure neither dad or mum were bankrupt etc - my worry now is because i have the same surname will the solicitors give him a list of those on the insolvency register to confirm they aren’t on it? obviously my name will come up and he will then find out! - for info i am not due to receive any funds this is just so everything can be transferred to Dad. any help would be great.

  • Don't worry, imagine your name was Smith, do you think any solicitor would go through all the Smiths to look for a connection?

    Does your  dad have to apply for probate was there a large sum of money involved?
    If you go down to the woods today you better not go alone.
  • yes so because Mum has over £50,000 in her account he has to apply for probate. think she has about £90,000. my brain goes into overdrive thinking he will find out if his produced a list!

    No, they can`t just produce a list, its due to data protection, they would be violating the other persons data rights.

    You will be fine, the solicitor will be breaking GDPR if they were to divulge you as being on the insolvency register, when you are not the subject of, or party too, the situation.

    Absolutely correct.

    In addition, the Insolvency Service has just revamped the register so unless you have the same forename AND surname as your father you will not even show in a search

    I think they've made it more smartphone friendly. I don't like it so much but admit it is probably an improvement

  • i have another question guys, Dad is currently in the process of revamping his will after the loss of Mum and in there he wants to state that everything is to be left to me and my sister - at the moment he just needs to supply the solicitor with my name and address - again would he be able to find out i have a DRO? like is it something that will be mentioned? as you can tell i worry about everything!
