Just an update, I filed my DQs with court and sent copies to both VCS and Elms legal. Got acknowledgement back from the court and replies from both VCS and Elms legal. VCS said Elms Legal were dealing with it and Elms legal said VCS were dealing with it - Bizarre or are they just playing games.
The deadline for submitting DQs was 14th Oct and so far neither VCS or Elms have sent their DQ to myself and there is no mention of theirs on the mcol portal.
Got a letter today from VCS saying Elms are no longer acting on their behalf and they will now be dealing with it. The letter is signed by Jake Burgess and appears to be their legal rep. Looking him up he seems to work for Excel Parking. I guess Excel, VCS and Elms are all part of the same unit.
It will be interesting to see how all this turns out.0 -

Had my appointment with the mediator this week. Interestingly VCS came back with an offer of £60 to settle. Of course I rejected it and off we go to court I guess. But I did find it interesting that they dropped from £255 to only £60.
The other interesting point was that they told the mediator that I had admitted to being the driver early on, of course I hadn't and I have all the correspondence that has ever taken place between us. But it does highlight what they might to try to suggest in a hearing and I need to make sure I have the evidence on hand to counter that.5 -
Today I received a letter from VCS "Notice of discontinuance" - so it looks like they have given up. It hasn't been updated on MCOL yet but I guess that may take a few days. I'll confirm back when I see it on MCOL.
In the meantime, I would like to say a big thank you to all of you for the advice, information, support and giving me the confidence to keep fighting them.5 -
Yay! That's a quick win after defence.
Sounds like you came through as someone not to be messed with when they tried at Mediation to lie that you'd earlier admitted to driving.
Hence they offered to settle a £255 court claim at the £60 discount level even after expending a £35 court fee, then discontinued when you didn't bite.
