Armtrac PCN Stennack St Ives - Wrong Reg JustPark

Hi,
Had a PCN from Armtrac 18th August. Realised I paid for the parking using JustPark app but hadn't updated my RegNo to my new car. Appealed to Armtrac with receipt from JustPark explaining it was an honest mistake but the letter back didn't mention anything about the fact I said that they would be able to see that my old reg didn't enter the car park on that day only that my new reg entered/exited and they had no ticket to validate against.
What should I do? Appeal to IAS or just pay £60 before it goes up to £100. Full reply from them below. TIA

Thank you for your appeal received on 23/08/2024 regarding the above detailed Parking Charge Notice.
We have reviewed the case and considered the comments that you have made. This appeal has been considered
in conjunction with the evidence gathered. Our records show that the notice was correctly issued as your vehicle
was parked in breach of the Terms and Conditions of Parking. All motorists have a duty of care to abide by the
clearly displayed terms and conditions of parking in return for permission to park on site and Armtrac Security
Services have a duty of care to the landowner to ensure the clearly displayed terms and conditions of parking are
adhered to.
The System was checked to see if payment had been made using the app. There was no session booked for this
Car Park with the VRM [NEWREG] therefore the PCN was legitimately issued.
The app at the site is not a system implemented by Armtrac, it is one of the chosen methods of payment
employed by the landowner. It is a separate company. We have no access. Any booking information is
communicated to the ANPR camera at the site. Due to entering the wrong VRM [OLDREG] your vehicle had no
valid session booked at the time of the PCN’s issue. Therefore, your vehicle had no authority to be parked on
private land.
It is a driver’s responsibility to ensure that a ticket is either securely and clearly displayed on the dashboard or
windscreen of the vehicle, or that they have a valid session booked with the correct vehicle details and location
number.
The vehicle was ‘Parked with no valid parking session / permit.’
Whilst we sympathise with your circumstances, we cannot take mitigating circumstances into consideration, the
rules of parking are clearly stated on the warning signs. The landowner has set the rules of parking and employed
Armtrac Security Services to ensure the rules of parking are adhered to.
Our warning signs clearly inform members of the public what the charge will be if they are to breach the rules of
parking on private land. All photographic evidence can be viewed online at www.armtracservices.co.uk by
entering both your PCN reference number and VRM.
Armtrac Security Services are not the landowner, we have been contracted by the landowner to ensure the clearly
displayed site rules of parking are being adhered to. The landowner has requested that any vehicles left on site in
contravention of the rules be issued with a PCN. Landowners have the right to set the rules of parking on their
land and the right to enforce those rules.
The landowner at this site has stated that all vehicles permitted to park on site will have already obtained a valid
permit, cashless payment session or a pay & display ticket. If any vehicles were going to be parked on site without
a permit, cashless payment session or pay & display ticket we would have been informed of the vehicle
registration details by the landowner so this vehicle could be placed on our authorised vehicle list exempt from the
parking regulations.
We are therefore unable to cancel this Parking Charge Notice as it was issued correctly. The case is now
considered closed. You now have 3 options from which to choose- 1. Pay the Parking Charge Notice of £60.00
within 14 days, after which time the discounted rate will no longer apply and the Parking Charge Notice will rise to
£100.00. 2. Make an appeal to the IAS. The Independent Appeals Service (www.theIAS.org) provides an
Alternative Dispute Resolution scheme for disputes of this type. As you have complied with our internal appeals
procedure you may use, and we will engage with, the IAS Standard Appeals Service providing you lodge an
appeal to them within 28 days of this rejection. In order to appeal, you will need your parking charge number, your
vehicle registration and the date the charge was originally issued. Please note that if you wish to appeal to the IAS
you will lose the right to pay the charge at the discounted rate of £60.00 and should the IAS's decision not go in
your favour you will be required to pay the full amount of £100.00. 3. If you choose to do nothing and the Parking
Charge Notice remains unpaid after 35 days the matter may be passed onto other hands for collection.
