TERMS AND CONDITIONS for “KISS FM x Costa Coffee Party Raffle Prize 19th September

(the “Competition”)

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail.

1.ENTRY PLATFORMS AND COSTS

1.ENTRY ROUTES AND COSTS

Entries are restricted to one entry per person. Entry to the Competition is available at the ‘Costa Maple Hazel Party’, taking place on Thursday 19th September 2024 at 104 New Oxford St, London WC1A 1HB. Each guest will be provided a raffle ticket upon entry.

1. COMPETITION MECHANIC AND HOW TO WIN

Prize winners will be selected by random selection in our raffle on the day of the party, in line with the date above. ENTRY PLATFORMS AND COSTS

Eligibility:

a. The raffle is open to all attendees of the ‘Costa Maple Hazel Party’, aged 18 years or older.

b. Each participant is entitled to receive one (1) raffle ticket upon entry to the event.

Earning Additional Tickets:

a. Participants have the opportunity to earn additional raffle tickets by participating in the separate "Spin to Win" game, taking place during the event.

b. Each successful spin on the "Spin to Win" game can award the participant one additional raffle ticket, subject to the game's specific rules and outcomes.

c. A participant can only win a maximum of 3 additional tickets by playing the "Spin to Win" game. The entry is capped at this number and any additional wins will be considered invalid.

Raffle Draw:

a. The raffle draw will take place on Thursday 19th September 2024 at some point between 20:45 (the “Start Time”) to 21:00 (“End Time”) .

b. Winning raffle numbers will be drawn at random by Jordan Banjo and Perri Kiely and announced during the event. Participants must be present to claim their prize.

c. If a raffle winner is not present when their number is called, the prize will be forfeited and a new number will be drawn.

Prize Collection:

a. Participants must present their winning raffle ticket(s) to claim the prize.

b. Prizes are non-transferable and cannot be exchanged for cash or substituted for other items, unless specified by the organiser.

Winner's Presence Requirement:

a. Participants must be present at the time of the raffle draw to claim their prize.

b. If a winning raffle number is called and the participant is not present, they will forfeit their prize.

Calling a New Raffle Ticket:

a. In the event of a forfeited prize due to absence, a new raffle ticket will be drawn immediately, and a new winner will be announced.

b. This process will continue until a present participant claims the prize.

1. DATES

Entries must be submitted during the following entry period:

From Thursday 19th September 2024 at 18:15 (the “Start Time”) to 20:00 (“End Time”). Entries received before the Start Time or after the End Time will be invalid.

1. ENTRY RESTRICTIONS

Open to UK residents aged 18 years or over on date of entry.

Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter.

We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms.

Anyone who has won a Bauer competition to the value of £500 or more within the past 6 months on any Bauer Radio Brand, will not be eligible to take part in this competition nor will anyone else at their address. If by any chance they get through to the phone lines – any prize they have been successful with will not be awarded. 1. THE PRIZE

Event in person competition:

Prize package for 2 people includes

· 1 night’s hotel accommodation (3* min) in the winner’s choice of location, based on sharing a twin/double room with breakfast

· Dinner and drinks at a local pub/restaurant, up to the value of £60 per person including gratuity

Prize Packages for two (2) people are for two (2) adults, old, all of whom must travel at the same time with the same itinerary; At least 1 person travelling must be over the age of 18; where any travellers are aged under 18, they must have prior parental or guardian permission; Accommodation is based on two (2) adults sharing one (1) double occupancy room, in the winner’s chosen location; Accommodation will be selected by prize provider at their sole discretion and accommodation selection will vary dependent on location; A valid credit or debit card for incidentals may be required to guarantee your room on check in and therefore at least one of the travellers must possess and travel with a valid credit or debit card; The prize excludes all travel costs, meals and drinks, hotel incidentals, excursions, attractions, treatments, personal expenses and anything not expressly stated in the prize package; If unavailable, experiences and items of a similar nature and value may be offered at prize provider’s discretion; Winners must contact prize provider with three preferred travel dates in three separate months no later than six weeks prior to departure; Once booked, the prize cannot be amended or cancelled; Prize is non-refundable and non-transferable; no cash alternative is available; Prize cannot be taken over Christmas, New Year or over Public Holidays; Prize is valid for 12 months from the date of notification of winning, and all travel must be completed within that time; Dinner and drinks at the specified restaurant are provided to the value of £60 per person, including service charge; All cash allowances listed will be sent via bank transfer to the winner’s nominated account, recipient of funds must be aged 18 years or older; If the winner elects not to, or is unable to, use part of the prize, the winner will forfeit that part of the prize package; The Prize Provider is Element London Ltd. Any personal data submitted by the winner to the Prize Provider will be treated in accordance with Prize Provider’s privacy policy, which is accessible at https://element-london.com/element-london-privacy-policy-non-travel/

Terms and Conditions:

• Ticket holder names must be provided before tickets are issued. No name changes can be made after tickets are issued.

• No duplicate tickets will be issued to replace tickets that have been lost or stolen after they have been delivered, and nor will such tickets be refunded.

• Re-sale or attempted re-sale of tickets is not permitted and may result in the tickets being cancelled or entry refused without prior notification, refund, compensation or liability.

• Proof of age in the form of a valid photographic ID will be required on entry to the 2024 Kisstory Festival and may be required for the purchase of alcohol.

• Winners and their guests must arrive at the 2024 Kisstory Festivals at the same time.

• The 2024 Kisstory Festival organisers reserve the right of refusal of admission.

• If any tickets for Kisstory Festival are obtained or used in breach of the terms and conditions of entry, they will be automatically void. The bearer will be refused entry and, if already in the festival, will be ejected, in either case without refund.

Winners will be contacted at the end of the competition period and asked which one of the above KISSTORY festivals they would like tickets to. Delivery of the tickets will be via email 7 days before the event.

Winners and their guests must be 18 years of age to attend Kisstory Festivals. Valid photo ID may be required as proof of age on entry. Bauer Media recommends that winners and all guests bring a valid photo ID (passport or driving licence) or entry may be refused.

All costs and expenses not included within the prizes are the responsibility of the winners and their guest. This includes, but is not limited to, travel costs to get to the festival, and the costs of any food and/or drink purchased/ required.

OTHER CONDITIONS

1. DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize. Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. 1. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

1. MISCELLANEOUS.

Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.

Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.

We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.

You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.

We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.

Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.

As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
