No -one can make a new claim for income related ESA but if he's already on them then it's ok as long as the 35 hours of caring  a week he does does not contradict the reasons he claims PIP and is considered too unfit to work.
  • He’s already on them in checking if everything is okay for him
  • What is your specific concern about him claiming them?

As above.... you need to detail what's in your mind.... as on the face of it someone is getting benefits and you're asking if there is a problem with that..... what makes you think there is.. is it a moral question or a technical question or something else?

Well that combo is perfectly legitimate, provided he has a care/mobility need and is providing care for someone else who does. He may even be getting some help with his council tax and, if in rented accom, some help with that.
  • Thank you I was worried that claiming the 3 would affect things

As above.... in theory yes all 3 can be claimed at the same time.... possibly also help with housing costs/council tax too.. so no issue there. All three either have criteria relating to caring or disablement and naturally they should not be contradictory in detail for those claims. But there are disabled people out there with significant caring responsibilities... and your father on the face of it (as a relative likely you'll know for fact) is one.

As a note, it is no longer possible to make a new claim for income related ESA and in due course existing claimants can expect migration to Universal Credit.

As far as I'm aware, a new claim to income related ESA can still be made so long as the person is already receiving the old style contributory ESA. If it's the new style ESA that's in payment, or if there is no ESA in payment, then the claim has to be for Universal Credit.
It's for the above reason that at some stage in the next 15 months, everyone who is in receipt of the old contributory version of ESA will have it converted to new style contributory ESA, to prevent a claim for income related ESA from being made.
